S監(jiān)獄服刑人員考核獎(jiǎng)懲方法研究

【摘要】:監(jiān)獄作為國(guó)家的刑罰執(zhí)行機(jī)關(guān),依據(jù)懲罰和改造相結(jié)合、教育和勞動(dòng)相結(jié)合的原則,依法對(duì)罪犯實(shí)行執(zhí)行刑罰,將罪犯改造成為守法公民。2008年中央政法委書(shū)記周永康同志指出“監(jiān)管場(chǎng)所要把改造人放在第一位,要真正使他們痛改前非、重新做人,要把刑釋解教人員重新違法犯罪率作為衡量監(jiān)管工作的首要標(biāo)準(zhǔn)”。這給新時(shí)期的監(jiān)獄工作提出了新的目標(biāo),要求監(jiān)獄在完成好關(guān)押、看管服刑人員這一刑罰執(zhí)行職能的同時(shí),還要對(duì)服刑人員進(jìn)行思想改造,,不斷提升改造質(zhì)量,使他們從根源上認(rèn)罪服法、悔過(guò)自新,真正成為一名守法公民。做好對(duì)服刑人員的考核獎(jiǎng)懲是完成這一工作目標(biāo)的基礎(chǔ),因?yàn)橐惶琢己玫目己霜?jiǎng)懲方法能保證服刑人員在思想和行為上保持長(zhǎng)期穩(wěn)定,能激勵(lì)服刑人員的改造積極性,能促進(jìn)服刑人員不斷提升自身改造質(zhì)量。本文著眼于新時(shí)期監(jiān)獄工作目標(biāo),結(jié)合S監(jiān)獄的發(fā)展現(xiàn)狀,提出S監(jiān)獄現(xiàn)行服刑人員考核獎(jiǎng)懲方法在考核獎(jiǎng)懲的方式、內(nèi)容、地位、進(jìn)程、權(quán)力分配、銜接協(xié)調(diào)等方面存在著問(wèn)題,并分析了產(chǎn)生這些問(wèn)題的原因。對(duì)S監(jiān)獄服刑人員考核獎(jiǎng)懲方法提出了優(yōu)化建議,建議中引入了目標(biāo)考核法、相關(guān)矩陣法等考核方式,將定量考核與定性考核有機(jī)的結(jié)合起來(lái);依據(jù)馬斯洛需求層次、雙因素等經(jīng)典理論,豐富了考核獎(jiǎng)懲的內(nèi)容,使考核獎(jiǎng)懲更具針對(duì)性和激勵(lì)約束作用;同時(shí)也對(duì)考核內(nèi)容的權(quán)重,考核獎(jiǎng)懲工作的程序提出了調(diào)整建議。使優(yōu)化后的服刑人員考核獎(jiǎng)懲方法能更好的為監(jiān)獄工作、社會(huì)穩(wěn)定提供重要保障。
[Abstract]:As the state's penal enforcement organ, prisons, in accordance with the principle of the combination of punishment and reform, education and labor, carry out the punishment of criminals in accordance with the law. In 2008, Comrade Zhou Yongkang, secretary of the Central Committee of political Science and Law, pointed out that "the place of supervision should put the reformed people at the top of the list, so that they can really change their minds and make a fresh start." We should take the crime rate of reentry of released prisoners as the primary standard of supervision. This has set a new goal for prison work in the new period, which requires prisons to carry out ideological reform and constantly improve the quality of prison inmates while completing the penal execution functions of the prisoners and guarding the prisoners. So that they confess to the root, repentant, truly a law-abiding citizen. To do a good job in assessing, rewarding and punishing prisoners is the basis for accomplishing this work goal, because a set of good assessment rewards and punishments can ensure the long-term stability of the prisoners in their thinking and behavior, and can stimulate the reform enthusiasm of the prisoners. Can promote the inmates to continuously improve their own transformation quality. Based on the aim of prison work in the new period and the present situation of S prison, this paper puts forward the methods of reward and punishment for the present prisoners in S prison, including the way, content, status, process and distribution of power. There are some problems in connection and coordination, and the causes of these problems are analyzed. This paper puts forward some optimized suggestions on the methods of reward and punishment for the evaluation of prisoners in S prison, including the introduction of objective assessment method, correlation matrix method and other assessment methods, which combine the quantitative assessment with qualitative assessment organically, according to Maslow's demand level, The classical theory of double factors enriches the contents of the examination rewards and punishments, makes the examination rewards and punishments more targeted and motivating and binding, and also puts forward some suggestions to adjust the weight of the examination contents and the procedure of the examination rewards and punishments. The optimized method of evaluation, reward and punishment can provide important guarantee for prison work and social stability.
