【摘要】：正社區(qū)矯正檢察工作實踐中,經(jīng)常會遇到暫予監(jiān)外執(zhí)行罪犯又犯罪的問題。對暫予監(jiān)外執(zhí)行期間又犯罪的罪犯從辦理到收監(jiān)執(zhí)行,有以下問題需要厘清:一是罪犯暫予監(jiān)外執(zhí)行期間又犯罪,應(yīng)由檢察機關(guān)哪個部門負責審查逮捕、審查起訴及開展相關(guān)訴訟監(jiān)督工作;二是罪犯暫予監(jiān)外執(zhí)行期間又犯罪,如何計算刑期;三是罪犯暫予監(jiān)外執(zhí)行期間脫逃的認定問題;四是罪犯暫予監(jiān)外執(zhí)行期間又犯罪的,應(yīng)當如何收監(jiān)執(zhí)行。筆者對此逐一探析,以拋磚
