人民監(jiān)督員制度的現(xiàn)狀、問(wèn)題及完善

【摘要】:為了加強(qiáng)外部監(jiān)督,切實(shí)防止和糾正檢察機(jī)關(guān)查辦職務(wù)犯罪工作中執(zhí)法不公的問(wèn)題,根據(jù)憲法和法律關(guān)于一切國(guó)家機(jī)關(guān)必須傾聽(tīng)人民的意見(jiàn)、接受人民的監(jiān)督的規(guī)定,最高人民檢察院經(jīng)報(bào)告全國(guó)人大常委會(huì)并經(jīng)中央同意,從2003年9月起開(kāi)展人民監(jiān)督員制度試點(diǎn)工作,并在天津、河北、內(nèi)蒙古等10個(gè)省(區(qū)、市)檢察機(jī)關(guān)試點(diǎn),后又報(bào)經(jīng)批準(zhǔn)于2004年8月部署擴(kuò)大試點(diǎn)范圍。實(shí)踐表明,人民監(jiān)督員制度的推行,有效地制約了檢察機(jī)關(guān)檢察權(quán)的行使,保護(hù)了犯罪嫌疑人的合法權(quán)利,促進(jìn)了程序公正,進(jìn)一步推進(jìn)了我國(guó)社會(huì)主義法治的建設(shè)。但與此同時(shí),人民監(jiān)督員的缺點(diǎn)與不足也進(jìn)一步的顯現(xiàn)了出來(lái),如人民監(jiān)督員的選任制度不夠合理、監(jiān)督的強(qiáng)制約束力不足、監(jiān)督程序不完善、人民監(jiān)督員的經(jīng)費(fèi)與完全保障不足等等,這些都直接制約著人民監(jiān)督員制度效果的進(jìn)一步發(fā)揮。基于此,有必要對(duì)人民監(jiān)督員制度進(jìn)行進(jìn)一步完善。 本文結(jié)構(gòu)上主要包括以下內(nèi)容:一是人民監(jiān)督員制度概述。主要論述了人民監(jiān)督員制度的創(chuàng)設(shè)背景,并簡(jiǎn)要概括了人民監(jiān)督員制度的主要內(nèi)容。二是人民監(jiān)督員制度的設(shè)立依據(jù)和作用。論述了人民監(jiān)督員制度的設(shè)立依據(jù),總結(jié)了人民監(jiān)督員制度的意義,并闡述了人民監(jiān)督員制度目前所取得的成效。三是人民監(jiān)督員制度的完善。本章指出了我國(guó)人民監(jiān)督員制度的在選任、任期、監(jiān)督的強(qiáng)制約束力、人民監(jiān)督員的了聘任、監(jiān)督程序、制度保障等方面的不足,并提出了完善措施。
[Abstract]:In order to strengthen external supervision and effectively prevent and correct the problem of unfair administration of justice in the investigation and handling of job-related crimes by procuratorial organs, according to the provisions of the Constitution and the law that all state organs must listen to the opinions of the people and accept the supervision of the people, After reporting to the standing Committee of the National people's Congress and with the approval of the Central Committee, the Supreme people's Procuratorate has carried out the pilot work of the people's Supervisor system since September 2003, and has carried out pilot projects in 10 provinces (autonomous regions and municipalities), including Tianjin, Hebei and Inner Mongolia. Later approved in August 2004 to expand the scope of the pilot. Practice shows that the implementation of the people's Supervisor system has effectively restricted the exercise of procuratorial power of procuratorial organs, protected the legitimate rights of criminal suspects, promoted procedural justice, and further advanced the construction of socialist rule of law in China. At the same time, however, the shortcomings and deficiencies of the people's supervisors have also been further revealed. For example, the selection and appointment system of the people's supervisors is not reasonable, the compulsory binding force of the supervision is insufficient, and the supervisory procedures are not perfect. The funds and the complete guarantee of the people's Supervisors are insufficient, which directly restricts the further development of the effect of the people's Supervisors system. Based on this, it is necessary to further improve the system of people's supervisors. The structure of this paper mainly includes the following contents: first, the outline of the people's Supervisor system. This paper mainly discusses the background of the establishment of the people's Supervisor system, and briefly summarizes the main contents of the people's Supervisor system. Second, the establishment of the people's Supervisor system and the role of the basis. This paper discusses the basis for the establishment of the people's Supervisor system, summarizes the significance of the people's Supervisor system, and expounds the achievements of the people's Supervisor system at present. Third, the improvement of the system of people's supervisors. This chapter points out the deficiencies of the people's Supervisor system in the selection, tenure, compulsory binding force of supervision, the appointment of the people's Supervisor, the procedure of supervision and the guarantee of the system, and puts forward some measures to improve it.
