檢察官遴選委員會(huì)設(shè)置問題研究

【摘要】:改革前,檢察官選任過程中存在的缺乏嚴(yán)格性、專業(yè)性、中立性和統(tǒng)一性等問題是設(shè)置遴選委員會(huì)的根本原因,配合當(dāng)前員額制檢察官改革是設(shè)置遴選委員會(huì)的現(xiàn)實(shí)需要。當(dāng)前,遴選委員會(huì)在法律定位、組織結(jié)構(gòu)、權(quán)力屬性和職能范圍等方面仍存在有待研究和亟須解決的問題。應(yīng)將遴選委員會(huì)定位為不依附任何國(guó)家機(jī)關(guān)的第三方專業(yè)性機(jī)構(gòu),具有從專業(yè)角度向檢察機(jī)關(guān)提出擬任命檢察官人選的建議權(quán),其職能范圍應(yīng)限定在具有初任性質(zhì)的檢察官遴選。
[Abstract]:Before the reform, the lack of strictness, professionalism, neutrality and unity in the selection process of the prosecutor is the fundamental reason for setting the selection committee, and the reform of the current post system is the actual need for the selection committee. At present, the selection committee is located in the law orientation, organization structure, power attribute and function scope. There are still problems to be studied and urgently needed to be solved. The selection committee should be positioned as a third party specialized agency that is not attached to any state organ, and has the right to propose the appointment of a prosecutor from a professional angle to the procuratorial organ from a professional point of view. The scope of its function should be limited to the selection of a prosecutor with a primary nature.
