【摘要】：法官道德是法官職業(yè)道德和法官個(gè)體道德的價(jià)值理念之和，是一種附加了職業(yè)屬性的特殊個(gè)體道德。法官道德具有主動性、獨(dú)特性和變動性的特點(diǎn)，而忠誠、公正、廉潔、文明是法官所應(yīng)具備的最基本的道德標(biāo)準(zhǔn)。 法官道德對司法裁判的作用體現(xiàn)在積極和消極兩個(gè)方面。積極方面，法官道德在司法裁判過程中會對法官個(gè)人和公眾的價(jià)值判斷產(chǎn)生導(dǎo)向作用，同時(shí)也會對法官的個(gè)體行為產(chǎn)生約束作用，防止法官權(quán)力的擴(kuò)張；而在消極方面，我們要制約法官在裁判中個(gè)體道德的過度使用，防止法官的經(jīng)驗(yàn)推理失于理性，以及司法裁判的泛道德化。 法官道德在司法裁判中的運(yùn)用會經(jīng)過以下過程：法官自身角色的多重性會使法官在司法裁判過程中出現(xiàn)不同角色間的沖突，致使法官在進(jìn)行案件評價(jià)時(shí)發(fā)生道德沖突。這些道德沖突，又使得法官必須經(jīng)過道德取舍做出相應(yīng)的道德選擇，而法官最終的道德選擇決定了司法裁判過程的最終走向以及司法裁判結(jié)果的可接受程度，進(jìn)而體現(xiàn)為司法裁判過程是否具有正當(dāng)性。另外，，法官道德對司法實(shí)體正義和程序正義的實(shí)現(xiàn)有極其重要的作用，既表現(xiàn)對程序正義實(shí)現(xiàn)的主導(dǎo)性，又表現(xiàn)對實(shí)體正義實(shí)現(xiàn)的內(nèi)心自律。 目前，我國法官整體的道德狀況較為良好，但仍存在亟待改善的不足之處。這就要求我們不僅要激活內(nèi)在約束來加強(qiáng)法官的道德修養(yǎng)，還要塑造外在制度以建立建全的法官道德保障機(jī)制。
[Abstract]:Judge morality is the sum of the value idea of judge's professional ethics and judge's individual morality, and it is a kind of special individual morality which is appended to professional attribute. Judge morality has the characteristics of initiative, uniqueness and variety, and loyalty, justice, honesty and civilization are the most basic moral standards that judges should possess. The function of judge morality to judicial judgment is reflected in both positive and negative aspects. On the positive side, judge morality will have a guiding role to judge's individual and public value judgment in the course of judicial adjudication, at the same time, it will also restrain judge's individual behavior, prevent judge's power from expanding, but in negative aspect, We should restrict the excessive use of the individual morality of the judge in the adjudication, prevent the judge's experience reasoning from losing the rationality, and the judicial judgment. The application of judge morality in the judicial decision will go through the following process: the multiple roles of the judge will cause the conflict between the different roles of the judge in the course of the judicial decision, resulting in the moral conflict of the judge in the evaluation of the case. These moral conflicts make judges have to make corresponding moral choices through moral trade-offs, and the final moral choice of judges determines the final direction of the judicial process and the acceptability of the judicial results. And then reflect whether the judicial process has legitimacy. In addition, judge morality plays an extremely important role in the realization of judicial substantive justice and procedural justice, which not only shows the leading role in the realization of procedural justice, but also shows the inner self-discipline for the realization of substantive justice. At present, the moral condition of the judges in our country is relatively good, but there are still some deficiencies that need to be improved. This requires us not only to activate internal constraints to strengthen the moral cultivation of judges, but also to shape the external system in order to establish a comprehensive moral guarantee mechanism for judges.
