【摘要】：家事案件中道德與法理交織,因此法官在緩和兩者之間沖突時(shí)傾向于自覺(jué)修正立法。家事調(diào)查官的設(shè)立,有助于法官?gòu)膶?shí)質(zhì)的角度全面把握案件的事實(shí)狀況,家事調(diào)查官對(duì)案件事實(shí)的干預(yù)是一種分類(lèi)干預(yù)。家事調(diào)查官介入家事案件具有天然的優(yōu)越性,以其輔助法官,可以將家事案件統(tǒng)一于情理與法理,實(shí)現(xiàn)公正裁斷。
[Abstract]:In family cases, morality and jurisprudence are intertwined, so judges tend to amend legislation consciously.The establishment of the family investigating officer is helpful for the judge to grasp the factual situation of the case from the substantive point of view. The intervention of the family investigating officer on the facts of the case is a kind of classified intervention.It is a natural advantage for a family investigating officer to intervene in a family case. With its auxiliary judge, a family case can be unified into reason and law, and a fair ruling can be realized.
