【摘要】：司法道德是責任行為的哲學。司法道德的核心任務是論述,是什么支配著法官的責任。司法職業(yè)倫理并非是指一種純粹的規(guī)范性倫理,而是指一種責任倫理,它關(guān)注的不僅僅是倫理規(guī)范,還關(guān)注由這些規(guī)范而產(chǎn)生的實際效果。法律和道德都是規(guī)范法官思想和行為,調(diào)節(jié)司法關(guān)系的重要手段。法官對法律規(guī)范的依賴是以職業(yè)共同體的強制力為后盾的;法官對司法倫理規(guī)范的依賴主要是通過法官內(nèi)心的榮譽感、義務感、責任感來實現(xiàn)的。法官道德價值不在于簡單地聽命于感官經(jīng)驗要求,而在于聽從于理性、良知。司法之治離不開法官之美德,法官美德包含對自身權(quán)利的某種體認與要求的人為美德。
[Abstract]:Judicial morality is the philosophy of responsible behavior.The core task of judicial morality is to discuss what dominates the responsibility of judges.Judicial professional ethics is not a kind of pure normative ethics, but a kind of responsibility ethics. It pays attention not only to the ethical norms, but also to the practical effects produced by these norms.Law and morality are important means to regulate the thought and behavior of judges and to regulate judicial relations.The reliance of judges on legal norms is backed by the coercive power of professional community, and the reliance on judicial ethical norms is mainly realized by the judges' inner sense of honor, obligation and responsibility.The moral value of judges lies not in simply obeying the demands of sensory experience, but in obeying reason and conscience.The administration of justice can not be separated from the virtue of the judge. The virtue of the judge includes the artificial virtue of recognizing and demanding his own rights.
