【摘要】：正一、人民法庭所處的社會場域社會學(xué)理論認(rèn)為,社會生活棲息于自身的世界即社會空間之中。作為社會生活的重要內(nèi)容,人民法庭的日常運(yùn)作亦必然在一定的社會空間中展開,欲理解鄉(xiāng)村司法的運(yùn)作邏輯,并對其作出適當(dāng)?shù)脑u價,則不可不對人民法庭所處的社會空間有一個較為清晰的認(rèn)識。(一)錦鎮(zhèn)人民法庭的轄區(qū)錦鎮(zhèn)人民法庭地處武陵山區(qū)東北部,下轄石溪和錦鄉(xiāng)兩個鄉(xiāng)鎮(zhèn),85個行政村,約9.5萬人。由于地處武陵山區(qū)腹地,其轄區(qū)地形十分復(fù)雜,盡管石溪與錦鄉(xiāng)互相接壤,然兩地地理環(huán)境迥異。人民法庭所在地的錦鄉(xiāng)由于有一條河流縱貫東西,其轄區(qū)多為河谷臺地,地勢較為平緩,錦鎮(zhèn)便坐落于河谷平地,兩岸邊緣則多懸崖峭壁。崖頂為高山地區(qū),錦鎮(zhèn)的轄區(qū)一直延伸到河流南岸崖頂?shù)母呱降貐^(qū),河流北岸崖頂則為與之比鄰的石溪鄉(xiāng)所轄,境內(nèi)山巒重
[Abstract]:First, the sociological theory of the social field in which the people's court is located holds that social life perches in its own world, that is, the social space.As an important part of social life, the daily operation of the people's Court is bound to be carried out in a certain social space. In order to understand the logic of the operation of rural justice and make an appropriate evaluation of it,Then there must be a clear understanding of the social space in which the people's courts are located.(1) the people's Court of Jin Town is located in the northeast of Wuling Mountain District, with 85 administrative villages and about 95000 people under the jurisdiction of Shixi and Jin Township.Because it is located in the hinterland of Wuling Mountain, its terrain is very complicated, although Shixi borders each other with Jinxiang, the geographical environment of the two places is quite different.Jinxiang, where the people's Court is located, has a river running east and west, and its jurisdiction is mostly river valley terraces, with a gentle terrain. Jin Town is located in the valley flat, and the edge of both sides of the bank is more precipice.The top of the cliff is a high mountain area, the jurisdiction of Jin Zhen extends to the high mountain area of the cliff top of the south bank of the river, and the cliff top of the north bank of the river is under the jurisdiction of the adjacent Shixi Township, with heavy mountains in its territory.
