【摘要】：長期以來,我國司法人員和地方法院經(jīng)費(fèi)按行政區(qū)域?qū)嵭蟹旨壒芾�、分級�?fù)擔(dān)的體制,不利于排除地方不當(dāng)干預(yù)。黨的十八屆三中全會(huì)以后,我國開始對司法體制進(jìn)行改革,黨的十八屆四中全會(huì)提出了全面深化司法體制改革的總目標(biāo),推進(jìn)國家法治體系和法治能力的現(xiàn)代化。目前,我國司法體制深化改革試點(diǎn)工作正在全面推開,法院財(cái)務(wù)管理法制化是此次深化改革的一項(xiàng)重要內(nèi)容。財(cái)務(wù)管理工作不僅僅是人民法院工作的一項(xiàng)組成部分,更是促進(jìn)人民法院正常履行審判職能,維護(hù)司法公平正義,推進(jìn)司法改革順利進(jìn)行的堅(jiān)實(shí)保障。在司法體制改革浪潮席卷而來的形勢下,人民法院財(cái)務(wù)管理法制化是大勢所趨。論文由三部分組成,第一部分概述了法院財(cái)務(wù)管理的基本涵義、應(yīng)遵循的基本原則和實(shí)現(xiàn)財(cái)務(wù)管理法制化的必要性;第二部分闡述了法院財(cái)務(wù)管理法制化現(xiàn)狀并提出我國目前存在的問題;第三部分闡述了域外發(fā)達(dá)國家國家和地區(qū)的法院財(cái)務(wù)管理法制化現(xiàn)狀和經(jīng)驗(yàn),同時(shí)針對我國法院財(cái)務(wù)管理法制化存在的問題提出完善的具體對策。
[Abstract]:For a long time, judicial personnel and local court funds in our country have been managed according to the administrative region, and the system of hierarchical burden is not conducive to the elimination of improper local intervention.After the third Plenary session of the 18th CPC Central Committee, China began to reform the judicial system. The fourth Plenary session of the 18th CPC Central Committee put forward the overall goal of comprehensively deepening the reform of the judicial system, and promoted the modernization of the country's legal system and capacity.At present, the trial work of deepening the reform of judicial system in our country is being carried out in an all-round way, and the legalization of court financial management is an important content of this deepening reform.Financial management is not only an integral part of the work of the people's court, but also a solid guarantee for the people's court to perform its judicial functions normally, safeguard judicial fairness and justice, and promote the smooth progress of judicial reform.Under the situation of the reform of judicial system, the legalization of people's court's financial management is the trend of the times.The thesis consists of three parts. The first part summarizes the basic meaning of the financial management of the court, the basic principles to be followed and the necessity of realizing the legalization of the financial management;The second part expounds the present situation of the legalization of the court financial management and puts forward the existing problems in our country, the third part expounds the present situation and experience of the legalization of the court financial management in the countries and regions of the foreign developed countries.At the same time, the author puts forward the perfect concrete countermeasures against the problems existing in the legalization of the court financial management in our country.
