【摘要】：互聯(lián)網(wǎng)時代,伴隨著新一輪科技革命和資訊科技的廣泛應(yīng)用,公眾對司法服務(wù)的需求發(fā)生了巨大變化,司法也面臨變革轉(zhuǎn)型的重大契機。目前,我國法院系統(tǒng)以智慧法院為目標開展信息化建設(shè),但主要局限于司法電子化作業(yè)這一工具層面,還沒有上升到方法論和價值層面。以嚴謹、繁瑣、封閉、程式化為特征的傳統(tǒng)司法,如何順應(yīng)公眾對司法服務(wù)便利化、快捷化、開放化、個性化的新需求,進行流程的優(yōu)化與改造,是這個時代司法所面臨的新挑戰(zhàn)。本文把資訊科技深度應(yīng)用于司法流程再造,分析了司法流程再造的必要性、基本原則和模式選擇,并以杭州互聯(lián)網(wǎng)法院的設(shè)立為例,探索了司法流程再造的試驗樣本,以期為未來的司法流程再造提供啟發(fā)與思路。
[Abstract]:In the Internet era, with a new round of scientific and technological revolution and the wide application of information technology, the public's demand for judicial services has undergone tremendous changes, and the judiciary is also facing a major opportunity of transformation.At present, the court system of our country takes the intelligent court as the goal to carry out the information construction, but it is mainly limited to the tool level of the electronic operation of the judicature, and has not yet risen to the level of methodology and value.The traditional judicature, which is characterized by rigorous, complicated, closed and stylized, how to adapt to the new demands of the public on the facilitation, quickness, openness and individuation of the judicial service, and how to optimize and reform the process,This is a new challenge facing the judiciary in this era.This paper applies information technology to judicial process reengineering, analyzes the necessity, basic principles and mode selection of judicial process reengineering, and takes the establishment of Hangzhou Internet Court as an example to explore the experimental sample of judicial process reengineering.In order to provide inspiration and ideas for the future judicial process reengineering.
