【摘要】：高素質(zhì)的法官是司法獨(dú)立和司法公正的重要保障。我國(guó)現(xiàn)階段基層法官遴選制度存在法官準(zhǔn)入條件過低、遴選對(duì)象范圍較窄以及遴選程序不規(guī)范等問題。究其原因,立法不完善、教育體制與法官遴選制度銜接不暢以及傳統(tǒng)歷史文化的影響等是主要影響因素。兩大法系在法官遴選制度方面積累的經(jīng)驗(yàn)為改革與完善我國(guó)的相應(yīng)制度提供了有益的啟示。針對(duì)我國(guó)的實(shí)際情況,基層法官遴選的改革與完善應(yīng)當(dāng)從嚴(yán)格法官的準(zhǔn)入條件和規(guī)范法官的遴選程序等方面著手。完善基層法官的遴選制度有利于早日實(shí)現(xiàn)法官的職業(yè)化、精英化與現(xiàn)代化。
[Abstract]:High-quality judges are an important guarantee of judicial independence and justice.At present, there are some problems in the selection system of judges at the grass-roots level in China, such as too low access conditions for judges, narrow range of selection objects and irregular selection procedures.The main factors are imperfect legislation, poor connection between education system and judge selection system, and the influence of traditional history and culture.The experience accumulated in the selection system of judges in the two legal systems provides beneficial enlightenment for the reform and perfection of the corresponding system in our country.In view of the actual situation of our country, the reform and perfection of the selection of judges at the grass-roots level should be carried out from the aspects of strict access conditions for judges and standardizing the selection procedures of judges.Improving the selection system of judges at the grassroots level is conducive to the professionalization, excellence and modernization of judges.
