【摘要】：根據(jù)于1955年4月4日130/NV/DC/ND號(hào)法令越南律師協(xié)會(huì)于1955年成立。律師協(xié)會(huì)在越南共產(chǎn)黨和越南社會(huì)主義共和國國家管理的領(lǐng)導(dǎo)。是一個(gè)政治-社會(huì)-職業(yè)組織,國家各律師的自愿統(tǒng)一組織,是越南祖國陣線的成員。 協(xié)會(huì)的運(yùn)作目的原則與建設(shè)越南社會(huì)主義法權(quán)國家事業(yè)密切連接。在越南目前的改革進(jìn)程,關(guān)于改革政治體制,建設(shè)社會(huì)主義法權(quán)國家,加強(qiáng)國際一體化事宜需要政治的整個(gè)體系的許多努力,其中有越南律師協(xié)會(huì)。有意義的戰(zhàn)略目標(biāo)之一是在參加建立法律政策工作中發(fā)揮越南律師協(xié)會(huì)的作用是值得的律師組織工作領(lǐng)域的建設(shè),實(shí)施和保護(hù)措施的性質(zhì)法律。 目前,越南律師協(xié)會(huì)正面臨著新的機(jī)遇和新挑戰(zhàn)。近年來在越南的立法工作已經(jīng)有許多重大的進(jìn)展。建設(shè)法律進(jìn)程更加民主執(zhí)行；法律文本的質(zhì)量更加提高。各政治和社會(huì)組織,公民個(gè)人已經(jīng)有許多機(jī)會(huì)和條件以對(duì)建設(shè)法律參加意見。與目前該國的發(fā)展,法律的作用和社會(huì)體制如律師協(xié)會(huì)政治注意過程中。黨和國家的許多文件已強(qiáng)調(diào),越南律師協(xié)會(huì)的重要作用。事實(shí)上,許多立法活動(dòng),教育和法制宣傳,法律援助黨和國家已分配給越南律師協(xié)會(huì)。在政治系統(tǒng)中律師協(xié)會(huì)的地位正在發(fā)展。 在研究和評(píng)估越南國家立法進(jìn)程現(xiàn)狀的基礎(chǔ)上并越南律師協(xié)會(huì)的參加在過去時(shí)間已經(jīng)參加于建立法律進(jìn)程,論文主要集中研究一下主要問題： 研究建設(shè)現(xiàn)行法律進(jìn)程；參加參加建立越南律師協(xié)會(huì)法律和各法律的專門機(jī)構(gòu)現(xiàn)狀。從此,評(píng)估關(guān)于立法進(jìn)程的有效作用和存在問題現(xiàn)行法律規(guī)定的缺點(diǎn)現(xiàn)狀；在立法過程中。評(píng)估越南律師協(xié)會(huì)的客觀性作用和有效地位。 建議機(jī)制讓律師協(xié)會(huì)有效參與立法過程。具體建議,建議完善有關(guān)法律,概述法治社會(huì)的基本內(nèi)容和參加建立法律。 在參與立法進(jìn)程的各個(gè)階段過程中綜合和分析以澄清律師協(xié)會(huì)的能力以及存在的缺陷。從此,建議解決方案讓越南律師協(xié)會(huì)促進(jìn)的作用,直接參與法律,以補(bǔ)充和完整和克服當(dāng)前的立法進(jìn)程目前的缺點(diǎn),目的是加強(qiáng)在越南法制。
[Abstract]:The Vietnamese Bar Association was established in 1955 by decree No. 130/NV/DC/ND of 4 April 1955. The Bar Association is under the leadership of the Communist Party of Viet Nam and the State Administration of the Socialist Republic of Viet Nam... is a political-socio-professional organization, The voluntary unified organization of the national lawyers is a member of the Viet Nam Fatherland Front. The principle of the purpose of the operation of the Association is closely linked to the cause of building a socialist legal power state in Viet Nam. In the current reform process in Viet Nam, concerning the reform of the political system and the building of a socialist legal power country, Strengthening international integration requires many efforts by the entire political system, Among them, the Vietnamese Bar Association. One of the significant strategic objectives is to play the role of the Vietnamese Bar Association in the establishment of legal policy is worthy of the construction of the field of lawyers, implementation and protection measures of the nature of the law. At present, the Vietnamese Bar Association is facing new opportunities and new challenges. In recent years, there has been many significant progress in the legislative work in Viet Nam to build a more democratic implementation of the legal process; The quality of the legal texts has been further improved. Political and social organizations, individual citizens have had many opportunities and conditions to participate in the construction of the law... with the current development of the country, The role of the law and the social system such as the Bar Association in the process of political attention... The important role of the Vietnamese Bar Association has been emphasized in many documents of the Party and the State... in fact, many legislative activities, education and legal publicity, The legal Aid Party and the State have been allocated to the Vietnamese Bar Association, whose status in the political system is evolving. Based on the study and assessment of the current status of the Vietnamese national legislative process and the participation of the Vietnamese Bar Association in the establishment of the legal process in the past, the paper focuses on the main issues:. (a) to study the current legal process; to participate in the establishment of the laws of the Viet Nam Bar Association and the various laws on the status of the specialized institutions... from then on, to assess the effective role of the legislative process and the shortcomings of the existing legal provisions; To evaluate the objectivity and effectiveness of the Vietnamese Bar Association in the legislative process. The suggestion mechanism allows the Bar Association to participate effectively in the legislative process. It also proposes to perfect the relevant laws, to outline the basic contents of the society ruled by law and to participate in the establishment of the law. Synthesis and analysis in all stages of the process of participation in the legislative process to clarify the capacity and shortcomings of the Bar Association... from then on, it is recommended that the solution allow the Vietnamese Bar Association to promote the role of direct participation in the law, To complement and complete and overcome the current shortcomings of the current legislative process with a view to strengthening the rule of law in Viet Nam.
