【摘要】：實(shí)行法官員額制是一項系統(tǒng)工程,既應(yīng)當(dāng)立足于法院人員分類管理現(xiàn)狀和法官工作實(shí)際,又必須依托科學(xué)嚴(yán)謹(jǐn)、全面翔實(shí)的數(shù)據(jù)分析。但現(xiàn)有研究大多焦聚于"誰來當(dāng)法官"的任職資格分析,卻多少忽視了"需要多少法官"這一前置性問題。為了提高法官員額配置的有效性和準(zhǔn)確性,我們應(yīng)借鑒計量經(jīng)濟(jì)學(xué)與統(tǒng)計學(xué)的建模方法,通過多重共線性檢驗將法官工作量作為確定法官員額的唯一解釋變量,而后建立以案件類型、工作任務(wù)、任務(wù)頻數(shù)、任務(wù)復(fù)雜性為核心的法官工作負(fù)荷模型,嘗試通過計算法官工作量測算法官員額。
[Abstract]:The implementation of the post system of judges is a systematic project, which should not only be based on the current situation of classified management of court personnel and the actual work of judges, but also rely on science and rigour. Comprehensive and informative data analysis. However, most of the existing research focuses on the analysis of the qualifications of "who to be a judge", while somewhat neglecting the pre-existing question of "how many judges are required"... in order to improve the effectiveness and accuracy of the staffing of judges, We should draw lessons from the modeling methods of econometrics and statistics, take the workload of judges as the sole explanatory variable for determining judges' posts through multiple collinear tests, and then establish the case types, work tasks, and frequency of tasks. Based on the workload model of judges with complexity as the core, this paper attempts to calculate judges' posts by calculating the workload of judges.
