【摘要】：媒體監(jiān)督和司法獨(dú)立是現(xiàn)代法治國(guó)家的兩大支柱。媒體監(jiān)督作為公民實(shí)現(xiàn)知情權(quán)和言論自由的主要渠道,對(duì)實(shí)現(xiàn)司法公正起著非常重要的作用;司法獨(dú)立是現(xiàn)代法治國(guó)家對(duì)司法權(quán)力配置及運(yùn)行的基本要求,是人類政治走向文明和法治的體現(xiàn)。在我國(guó)特殊的法制環(huán)境下,無(wú)可否認(rèn)媒體監(jiān)督在促進(jìn)司法改革、防范司法腐敗、實(shí)現(xiàn)司法公正方面起到的積極作用,同時(shí)也應(yīng)當(dāng)看到,媒體與司法的關(guān)系還遠(yuǎn)遠(yuǎn)沒(méi)有被理順。日益復(fù)雜的媒體與司法的沖突已成為法學(xué)界關(guān)注的熱點(diǎn)之一,如何處理好兩者之間的關(guān)系,衡平兩者的利益沖突,是現(xiàn)代法治國(guó)家必須解決的課題。本文圍繞這一對(duì)研究對(duì)象,通過(guò)對(duì)典型案例的回顧和分析,想著力厘清如下問(wèn)題:一是媒體監(jiān)督和司法獨(dú)立的價(jià)值何在;二是媒體監(jiān)督與司法獨(dú)立二者的關(guān)系如何;三是如何實(shí)現(xiàn)兩者間的合理構(gòu)建。
[Abstract]:Media supervision and judicial independence are two pillars of a modern country ruled by law. As a main channel for citizens to realize their right to know and freedom of speech, media supervision plays a very important role in the realization of judicial justice. Judicial independence is the basic requirement for the distribution and operation of judicial power in a modern country ruled by law, and the embodiment of human politics towards civilization and the rule of law. Under the special legal environment of our country, it is undeniable that media supervision is promoting judicial reform. The prevention of judicial corruption and the realization of judicial justice play a positive role. At the same time, we should also see that the relationship between the media and the judiciary is far from being straightened out. The increasingly complex conflict between the media and the judiciary has become one of the hot spots concerned by the legal circles. How to deal well with the relationship between the two and balance their conflicts of interest is a subject that must be solved in a modern country ruled by law. Thinking of clarifying the following problems: first, the value of media supervision and judicial independence; second, the relationship between media supervision and judicial independence; third, how to achieve a reasonable construction between the two.
