【摘要】：隨著社會主義市場經(jīng)濟的深入發(fā)展,農(nóng)民工這一特定群體不斷壯大,同時成為弱勢群體的主要部分。農(nóng)民工群體因其背井離鄉(xiāng)、知識水平普遍較低、從事勞動密集型產(chǎn)業(yè)、收入較低、與外界接觸較少、所服務(wù)的企業(yè)管理存在諸多不合法的情況等各方面特點,導(dǎo)致這一群體成為合法權(quán)益被侵害最普遍、最嚴(yán)重且維權(quán)最為艱辛的主體。 農(nóng)民工法律保障方面的缺失,不僅把農(nóng)民工推向絕望的深淵,同時又催化了矛盾向深度發(fā)展。在構(gòu)建社會主義和諧社會的大背景下研究和解決農(nóng)民工法律援助問題具有重大的現(xiàn)實意義。在現(xiàn)今形勢下,要保持經(jīng)濟平穩(wěn)較快發(fā)展,必須把社會穩(wěn)定作為各項工作的重中之重,而農(nóng)民工權(quán)益維護直接關(guān)系到社會穩(wěn)定的大局,關(guān)系到和諧社會的構(gòu)建。如果數(shù)量龐大的農(nóng)民工群體合法權(quán)益得不到有效維護,出現(xiàn)不穩(wěn)定不和諧因素,勢必影響到大局的穩(wěn)定。 農(nóng)民工的法律援助是一個系統(tǒng)性工程,當(dāng)前我國農(nóng)民工法律援助工作中主要遇到的困難及存在的問題主要有：農(nóng)民工法律概念界定不清、農(nóng)民工法律援助立法滯后、農(nóng)民工法律援助司法支持力度不夠、農(nóng)民工法律援助執(zhí)法機構(gòu)設(shè)置不健全、農(nóng)民工法律援助宣傳不夠、農(nóng)民工法律援助資金短缺、法律援助門檻高、農(nóng)民工法律維權(quán)的成本高障礙多,等等。所以農(nóng)民工法律援助制度的完善,不僅需要政府的重視和推進,更要社會組織和個人的堅持和努力,形成維護農(nóng)民工合法權(quán)益的強大合力。為此,我們應(yīng)當(dāng)通過為農(nóng)民工法律援助提供更多的法律支持,加強法律援助宣傳,多渠道籌集法律援助資金,完善法律援助機構(gòu)建設(shè),加強法律援助的部門合作機制及取消戶籍制度加速農(nóng)民向平等的城里人邁進等措施,更好的保護農(nóng)民工的利益不受侵害。
[Abstract]:With the development of socialist market economy, this particular group of migrant workers continue to grow, and become a major part of vulnerable groups. Because of the migrant workers leave the hometown, the knowledge level is generally low, labor-intensive, low income, less contact with the outside world, the enterprise management service exists in all aspects of many illegal cases the characteristics of this group, to become the most common legitimate rights and interests have been infringed, the most serious and most difficult rights subject.
The lack of legal protection of migrant workers, migrant workers not only to the abyss of despair, and the contradiction between the depth of the development of catalytic. To study and solve the problem of migrant workers legal aid in the context of building a socialist harmonious society is of great practical significance. In the current situation, to maintain stable and rapid economic development, the social stability must be as heavy in the work, and safeguarding the rights and interests of migrant workers is directly related to social stability, to build a harmonious society. If a large number of migrant workers' legitimate rights and interests are not effectively safeguarded, unstable factors of disharmony, is bound to affect the stability of the overall situation.
Legal aid for migrant workers is a systematic project, mainly to meet legal aid for migrant workers in China's current difficulties and the main problems are: the legal concept of migrant workers is not clearly defined, the lag of migrant workers legal aid legislation, migrant workers legal aid judicial support is not enough, migrant workers legal aid law enforcement agencies are not perfect, migrant workers legal aid propaganda not enough, the legal aid funds shortage of migrant workers, migrant workers legal aid threshold is high, the legal rights of the high cost of many obstacles, and so on. So the improvement of migrant workers legal aid system, not only need the government's attention and promotion, should adhere to and efforts of social organizations and individuals, to form a powerful force to safeguard the legitimate rights and interests of migrant workers. Therefore, we should by providing more legal support for migrant workers legal aid, legal aid to strengthen propaganda, multi-channel to raise legal aid In order to better protect the interests of migrant workers, we should improve the construction of legal aid institutions, strengthen the cooperation mechanism of legal aid departments, abolish the household registration system, and speed up the movement of farmers to equal townspeople.
