【摘要】：近年來，隨著司法不公現(xiàn)象的出現(xiàn)，新聞監(jiān)督不斷強化。在良性互動關(guān)系上，新聞監(jiān)督能促進司法公正；在互相規(guī)范方面，新聞監(jiān)督能推進社會主義法治建設(shè)，起到震懾司法腐敗的積極作用；在互相支持方面，司法公正也能為新聞監(jiān)督提供法律和制度層面的保障。探討新聞監(jiān)督下我國司法公正實現(xiàn)的路徑，需要通過立足我國國情，借鑒國外成功的經(jīng)驗，明確司法公正與新聞監(jiān)督的指導(dǎo)思想和理論原則，尋找新聞監(jiān)督對司法公正影響的表現(xiàn)及原因，才能得出比較明確的結(jié)論。 當(dāng)前，新聞監(jiān)督對司法審判活動起到日益重要的作用，不僅震懾了司法腐敗，而且進行了普法宣傳，，從某種意義來說有助于弘揚良好的社會風(fēng)氣和充分發(fā)揮監(jiān)督的作用。新聞監(jiān)督作為實現(xiàn)司法公正的重要手段，與司法公正具有價值追求的一致性，但由于新聞監(jiān)督與司法活動采用的具體評價標(biāo)準不同，相關(guān)的法律法規(guī)不健全及行業(yè)自律問題等方面的原因，在實踐中，新聞監(jiān)督又在一定程度上與司法公正存在沖突，這種不協(xié)調(diào)狀態(tài)的發(fā)展將相互削弱各自的作用。 本文在參考當(dāng)前學(xué)術(shù)界眾多研究成果的基礎(chǔ)上，對新聞監(jiān)督與司法公正的概念進行了辨析和界定，結(jié)合實例，并從法學(xué)理論的角度入手，分析并論證了新聞監(jiān)督對保障司法公正實現(xiàn)的積極作用，在實踐中存在的新聞監(jiān)督對司法公正的消極影響及其原因，借鑒域外的成功經(jīng)驗，結(jié)合我國實際，提出了完善新聞監(jiān)督、實現(xiàn)司法公正、促進二者協(xié)調(diào)發(fā)展的幾點建議。
[Abstract]:In recent years, with the appearance of unfair judicial phenomenon, the news supervision has been strengthened. In the benign interaction, the news supervision can promote the judicial justice, and in the aspect of mutual standardization, the news supervision can promote the construction of the socialist rule of law. In the aspect of mutual support, judicial justice can also provide legal and institutional protection for news supervision. In order to explore the path of realizing judicial justice under news supervision, we need to base ourselves on our country's national conditions. Only by referring to the successful experience of foreign countries, clarifying the guiding ideology and theoretical principles of judicial justice and news supervision, and finding out the performance and reasons of the influence of news supervision on judicial justice, can we reach a relatively clear conclusion. At present, news supervision plays an increasingly important role in judicial activities, not only deterring judicial corruption, but also popularizing the law. In a sense, it is helpful to carry forward the good social atmosphere and give full play to the role of supervision. As an important means to realize judicial justice, news supervision is consistent with the value pursuit of judicial justice. However, due to the difference between the specific evaluation standards adopted by the news supervision and the judicial activities, the imperfect laws and regulations and the problems of self-discipline of the industry, in practice, the news supervision also conflicts with the judicial justice to a certain extent. The development of this state of disharmony will weaken each other's role. On the basis of many research achievements in current academic circles, this paper distinguishes and defines the concepts of news supervision and judicial justice, combines with examples, and starts from the angle of legal theory. This paper analyzes and demonstrates the positive effect of news supervision on the realization of judicial justice, the negative influence of news supervision on judicial justice in practice and its reasons, and draws lessons from the successful experiences of foreign countries and combines the reality of our country. Some suggestions are put forward to perfect the news supervision, realize the judicial justice and promote the harmonious development of the two.
