【摘要】：網(wǎng)絡(luò)作為民意表達(dá)的一種新的場域,源自于現(xiàn)代信息技術(shù)的發(fā)展和以民意表達(dá)機(jī)制不暢的雙重需求和機(jī)遇,在此基礎(chǔ)上,網(wǎng)絡(luò)民意的監(jiān)督也逐漸侵蝕到司法活動的界域。學(xué)者們對司法和網(wǎng)絡(luò)民意的關(guān)系從不同的角度進(jìn)行了解讀,眾說紛紜。筆者在仔細(xì)梳理了學(xué)者們的不同觀點(diǎn)后,通過對網(wǎng)絡(luò)民意與司法關(guān)系現(xiàn)狀的闡述,分析了二者產(chǎn)生沖突的原因,試圖構(gòu)建網(wǎng)絡(luò)民意與司法的良性互動機(jī)制。 本文分為三個部分,主要有以下幾個方面內(nèi)容：首先闡述民意、網(wǎng)絡(luò)民意的涵義、功能及特征與司法的概念,二者互動關(guān)系的理想模式,為后文的論述作鋪墊。然后闡述了網(wǎng)絡(luò)民意與司法在我國的關(guān)系現(xiàn)狀,對司法活動產(chǎn)生的影響。之后進(jìn)一步探索兩者沖突的原因,如：網(wǎng)絡(luò)暴力的存在、網(wǎng)絡(luò)民意理性的缺失、網(wǎng)絡(luò)自由使得信息過剩和信息異化；司法信賴危機(jī)的加��；網(wǎng)絡(luò)民意與司法活動的角色差異。最后一部分提出了網(wǎng)絡(luò)民意與司法良性互動的路徑,機(jī)制的構(gòu)建和具體的實(shí)施措施。只有在兩者之間尋求適度的平衡,找到最佳的契合點(diǎn),才能實(shí)現(xiàn)兩者的良性互動,進(jìn)而推動民主法治的進(jìn)程。
[Abstract]:As a new field of public opinion expression, the network derives from the dual demand and opportunity of the development of modern information technology and the poor expression mechanism of public opinion. The supervision of network public opinion also gradually erodes the boundary of judicial activities. Scholars interpret the relationship between justice and network public opinion from different angles and have different opinions. After carefully combing the different viewpoints of scholars, By expounding the current situation of the relationship between network public opinion and judicature, this paper analyzes the causes of the conflict between them, and tries to construct a benign interactive mechanism between network public opinion and judicature. This paper is divided into three parts, mainly as follows: first of all, it expounds the public opinion, the meaning, function and characteristics of network public opinion and the concept of judicature, and the ideal model of the interaction between the two. Then it expounds the current situation of the relationship between the network public opinion and the judicature in our country, and the influence on the judicial activities. Then it further explores the causes of the two conflicts, such as the existence of the network violence, the lack of the rationality of the network public opinion. Network freedom makes information surplus and information dissimilation; the crisis of judicial trust intensifies; the role difference between network public opinion and judicial activity. The last part puts forward the path of benign interaction between network public opinion and judicature. Only by seeking a proper balance between the two and finding the best fit point can the benign interaction between the two be realized and the process of democracy and rule by law be promoted.
