【摘要】：目前,伴隨著我國(guó)政治、經(jīng)濟(jì)、法治、文化的快速發(fā)展,公證在社會(huì)政治、經(jīng)濟(jì)領(lǐng)域中所占的地位日益重要,當(dāng)今時(shí)代賦予了中國(guó)公證員促進(jìn)經(jīng)濟(jì)和諧發(fā)展,維護(hù)社會(huì)公平正義,構(gòu)建社會(huì)信用體系的莊嚴(yán)使命。但我國(guó)的《公證法》及相關(guān)規(guī)定卻嚴(yán)重滯后,對(duì)公證員的性質(zhì)、地位均缺乏明確的規(guī)定,這使得我國(guó)公證員的責(zé)權(quán)利嚴(yán)重失衡,導(dǎo)致公證員面臨著諸多執(zhí)業(yè)風(fēng)險(xiǎn)。 本文以公證制度的起源為切入點(diǎn),先從對(duì)于公證員概念和公證制度的概述入手,通過(guò)對(duì)中外公證法律制度體系的起源及發(fā)展進(jìn)程的論述,對(duì)于中外公證法律制度中關(guān)于公證員及公證制度的相關(guān)內(nèi)容加以概括性的闡述,之后運(yùn)用比較分析法,闡述國(guó)內(nèi)關(guān)于公證員法律制度的相關(guān)規(guī)定,進(jìn)而論述我國(guó)公證員法律制度的淵源、變革、現(xiàn)狀,以及公證員的法律性質(zhì)和法律定位問(wèn)題,接著運(yùn)用案例分析法詳細(xì)論述了我國(guó)公證員法律制度中存在的現(xiàn)實(shí)問(wèn)題--包括定性模糊、立法缺失、隊(duì)伍現(xiàn)狀、執(zhí)業(yè)風(fēng)險(xiǎn)等,并進(jìn)行定性分析,梳理規(guī)范制度,探討今后我國(guó)公證員法律制度的發(fā)展趨勢(shì)以及需要解決的現(xiàn)實(shí)問(wèn)題。最后針對(duì)存在問(wèn)題,提出我國(guó)公證員法律制度規(guī)制和完善的立法建議。主要包括完善法律體系,明確法律地位,加強(qiáng)隊(duì)伍建設(shè),完善執(zhí)業(yè)保障體系等內(nèi)容。
[Abstract]:At present, with the rapid development of politics, economy, rule of law and culture in our country, notarization plays an increasingly important role in the field of social politics and economy. The solemn mission of maintaining social fairness and justice and building a social credit system. However, the notarization Law and related regulations in our country lag behind seriously, and there are no clear regulations on the nature and status of notaries. This makes notaries' responsibilities and rights seriously out of balance and causes notaries to face a lot of professional risks. In this paper, the origin of notarization system as the breakthrough point, starting with the concept of notaries and notarization system overview, through the Chinese and foreign notarization legal system of the origin and development of the process of discussion, The relevant contents of notaries and notaries in the notarization system of China and foreign countries are summarized, and then the relevant provisions of the legal system of notaries at home and abroad are elaborated by means of comparative analysis. Then it discusses the origin, reform, present situation, legal nature and legal orientation of notaries in our country. Then it discusses in detail the practical problems existing in the legal system of notaries in China by case analysis, including qualitative ambiguity, lack of legislation, current situation of the team, practicing risks and so on, and carries on qualitative analysis, combs the standard system, and so on. This paper probes into the development trend of the legal system of notaries in our country in the future and the practical problems that need to be solved. Finally, aiming at the existing problems, the author puts forward some legislative suggestions for the regulation and perfection of the legal system of notaries in our country, which mainly includes the improvement of the legal system. Clear legal status, strengthen the building of the ranks, improve the practice security system and other content.
