【摘要】：刑法修正案(八)自2011年5月1日起施行,其中第二、十三、十七條規(guī)定了對判處管制、宣告緩刑、假釋的犯罪分子,在考驗(yàn)期內(nèi)依法實(shí)行社區(qū)矯正。我國于2003年開始社區(qū)矯正試點(diǎn)工作,雖然全國很多地方都制定了社區(qū)矯正制度并予以實(shí)踐,但是法律依據(jù)并不明確,而且標(biāo)準(zhǔn)也不一致,刑法修正案(八)明文規(guī)定將社區(qū)矯正入刑,為社區(qū)矯正工作的開展提供了明確的法律依據(jù)。檢察機(jī)關(guān)作為法律監(jiān)督機(jī)關(guān),負(fù)有偵查監(jiān)督、審判監(jiān)督、執(zhí)行監(jiān)督等監(jiān)督職責(zé),在新形勢下如何對執(zhí)行階段的社區(qū)矯正進(jìn)行監(jiān)督,是檢察機(jī)關(guān)面臨的新課題。 本文的第一部分是社區(qū)矯正的概述,包括社區(qū)矯正的起源、社區(qū)矯正的界定、社區(qū)矯正的特點(diǎn)、社區(qū)矯正的功能與價值、社區(qū)矯正的任務(wù)、檢察機(jī)關(guān)在社區(qū)矯正監(jiān)督中的職責(zé)等六個方面,讓讀者對社區(qū)矯正有個全方位的了解。 第二部分是比較法中的社區(qū)矯正,主要介紹了西方發(fā)達(dá)國家社區(qū)矯正的制度,與我國社區(qū)矯正的對比,歸納了我國社區(qū)矯正的現(xiàn)狀。 第三部分是本文的關(guān)鍵,首先說明了檢察機(jī)關(guān)監(jiān)督社區(qū)矯正的依據(jù),其次總結(jié)了當(dāng)前檢察機(jī)關(guān)監(jiān)督社區(qū)矯正面臨的問題,并重點(diǎn)分析了問題存在的原因,為最后一部分的解決問題做好了鋪墊。 文章最后,結(jié)合司法實(shí)踐,從完善監(jiān)督體系、內(nèi)部成立專門的社區(qū)矯正監(jiān)督部門、拓寬監(jiān)督方式、采用先進(jìn)的信息管理技術(shù)、建立評估機(jī)制等五大角度,提出了解決問題的方法,希望能夠?yàn)闄z察機(jī)關(guān)在新形勢下社區(qū)矯正進(jìn)行檢察監(jiān)督有所幫助。
[Abstract]:The amendment to the Criminal Law (8) shall enter into force as of May 1st 2011. Articles 2, 13, 17 of which provide for criminals who are sentenced to control, suspended or released on parole, In 2003, our country began the pilot work of community correction. Although many parts of the country have formulated the community correction system and put it into practice, the legal basis is not clear, and the standards are not consistent. The amendment to the Criminal Law (8) expressly stipulates that community correction shall be punished, which provides a clear legal basis for the development of community correction. As a legal supervisory organ, the procuratorial organ, as a legal supervisory organ, has the supervisory functions of investigation, trial supervision, and execution of supervision, etc. Under the new situation, how to supervise the community correction in the execution stage is a new task facing the procuratorial organs. The first part of this paper is an overview of community correction, including the origin of community correction, the definition of community correction, the characteristics of community correction, the function and value of community correction, the task of community correction. The function of procuratorial organ in the supervision of community correction makes readers have a comprehensive understanding of community correction. The second part is the community correction in the comparative law, mainly introduces the system of community correction in the western developed countries, compares with the community correction in our country, and sums up the present situation of the community correction in our country. The third part is the key of this paper. Firstly, it explains the basis of the procuratorial organ to supervise the community correction, then summarizes the problems faced by the procuratorial organ to supervise the community correction, and analyzes the reason why the problem exists. For the last part of the solution of the problem made a good foundation. Finally, combined with judicial practice, from the five angles of perfecting the supervision system, establishing a special community correction supervision department, broadening the supervision mode, adopting advanced information management technology, and establishing the evaluation mechanism, etc. This paper puts forward some methods to solve the problem, hoping to help the procuratorial organ to carry on the procuratorial supervision under the new situation.
