【摘要】：近年來(lái),隨著我國(guó)民主進(jìn)程的不斷加大,對(duì)弱勢(shì)群體的保護(hù)力度不斷加強(qiáng),人們的法律意識(shí)越來(lái)越強(qiáng)烈,就大連市中山區(qū)而言,近幾年,法律援助案件數(shù)量逐年遞增,由于管理制度的不完善,出現(xiàn)各種現(xiàn)實(shí)矛盾,政府對(duì)法律援助關(guān)注較少與需要大量經(jīng)費(fèi)保障出現(xiàn)矛盾,部分律師事務(wù)所和律師的利益至上與法律援助的公益性存在矛盾。各種矛盾異軍突起,如何解決這些矛盾,必須首先從政府管理角度加大對(duì)法律援助管理的力度,給予法律援助更多的關(guān)注,以及加強(qiáng)對(duì)律師事務(wù)所及律師的管理。只有政府先加大對(duì)法律援助的管理力度,整個(gè)社會(huì)才能給予弱勢(shì)群體更多的法律保障。如何加強(qiáng)對(duì)法律援助的管理,這已經(jīng)是擺在司法行政部門乃至整個(gè)政府面前的一個(gè)亟待解決的問(wèn)題。 本文運(yùn)用管理學(xué)、法學(xué)等相關(guān)學(xué)科理論,采用理論分析與實(shí)證研究相結(jié)合的研究方法,從法律援助及法律援助管理的概念出發(fā),總結(jié)法律援助主體、對(duì)象、辦案流程等,針對(duì)目前大連市中山區(qū)的現(xiàn)狀,借鑒國(guó)內(nèi)外典型城市及國(guó)家的先進(jìn)做法,對(duì)完善法律援助制度提出對(duì)策建議。 全文共分為四部分,第一部分介紹本文研究背景及意義,法律援助與法律援助管理及其價(jià)值,政府在法律援助管理中的職責(zé)；第二部分主要針對(duì)中山區(qū)法律援助制度的基本情況,從機(jī)構(gòu)設(shè)置、法律援助主體及對(duì)象的管理研究、辦案流程及條件等幾個(gè)方面,針對(duì)中山區(qū)法律援助基本情況,結(jié)合典型案例,闡述大連市中山區(qū)法律援助現(xiàn)階段存在的問(wèn)題及成因；第三部分介紹國(guó)內(nèi)法律援助管理的基本情況及國(guó)外法律援助管理的典型做法,總結(jié)管理經(jīng)驗(yàn)典型應(yīng)用于大連市中山區(qū)的法律援助制度中；第四部分針對(duì)存在的問(wèn)題,提出完善大連市中山區(qū)法律援助制度的對(duì)策建議。
[Abstract]:In recent years, with China's democratic process continue to increase efforts to protect vulnerable groups continue to strengthen people's legal consciousness is more and more intense, the Zhongshan District of Dalian City, in recent years, the number of legal aid cases increased year by year, the management system is not perfect, the various contradictions, the government on legal aid less attention and funding needs a large number of contradictions, the contradiction of public part of the interests of law firms and lawyers and legal aid. All kinds of contradictions and how to solve these contradictions, A new force suddenly rises., must first from the angle of government management to increase legal aid management, give more attention to legal aid, and the strengthening of the law firms and lawyers management. Only the government to intensify the management of legal aid, the whole society to give legal protection to more vulnerable groups. How to strengthen the The management of legal aid is an urgent problem facing the administrative department of the judiciary and even the whole government.
In this paper, the use of management science, law and other related theories, using the research methods of combination of theoretical analysis and empirical research, starting from the concept of legal aid and legal aid management, summarizes the main legal aid object, handling procedures, according to the present situation of Zhongshan District of Dalian City, draw lessons from the typical city and country at home and abroad to improve the legal aid system, puts forward some countermeasures and suggestions.
This paper is divided into four parts, the first part introduces the background and significance of this research, legal aid and legal aid management and value of government responsibility in legal aid management; the second part mainly according to the basic situation of Zhongshan district legal aid system, from the organization, management of the main body and the object of legal aid, a few handling process and the condition, according to the basic situation of legal aid in Zhongshan District, combined with a typical case, describes the problems and causes of legal aid in Zhongshan District of Dalian city at this stage; the third part introduces the basic situation and the typical practice of foreign legal aid management of domestic legal aid management, summarizes the management experience of the typical application in Zhongshan District of Dalian city law aid system; the fourth part in view of the existing problems, put forward some suggestions to improve the legal aid system in Zhongshan District of Dalian city.
