【摘要】：處于社會(huì)轉(zhuǎn)型期的中國(guó)面臨各種紛繁復(fù)雜的社會(huì)矛盾糾紛,如何有效化解這些矛盾糾紛,既是關(guān)系國(guó)家社會(huì)治理的問(wèn)題,也是考驗(yàn)司法智慧的難題。我國(guó)應(yīng)通過(guò)構(gòu)建多元化的社會(huì)矛盾糾紛解決機(jī)制,厘清人民調(diào)解、仲裁等民間糾紛解決方式與訴訟方式之間的功能劃分和作用方式,保護(hù)人民群眾合法利益,維護(hù)社會(huì)安定和諧。
[Abstract]:In the period of social transformation, China is faced with a variety of complicated social contradictions and disputes. How to effectively resolve these contradictions and disputes is a problem related to the social governance of the country. It is also a difficult problem to test judicial wisdom. In our country, we should construct a pluralistic social conflict and dispute resolution mechanism, and clarify the functional division and function between civil dispute resolution and litigation, such as people's mediation and arbitration. Protect the legitimate interests of the masses and maintain social stability and harmony.
