論我國統(tǒng)一司法考試制度的發(fā)展與完善

【摘要】:2001年全國人民代表大會常務(wù)委員會通過了修訂《中華人民共和國法官法》、《中華人民共和國檢察官法》、《中華人民共和國律師法》的決議,并決定將原來的初任法官考試、初任檢察官考試、律師職業(yè)資格考試?家荒,統(tǒng)一司法考試于2002年進行。自此,我國建立起了統(tǒng)一的法律職業(yè)資格考試制度(下文中稱統(tǒng)一司法考試制度)。 統(tǒng)一司法考試制度的確立在我國法治史上具有劃時代的意義。它的建立架起了法學(xué)教育和司法實踐之間的橋梁,將引導(dǎo)我國法學(xué)教育不斷完善,為我國法治建設(shè)選拔合格的法律人才,使我國法律職業(yè)共同體的構(gòu)建成為可能。 但統(tǒng)一司法考試實踐表明:它并沒有產(chǎn)生預(yù)期的效果,反而暴露出許多不足。比如報考條件要求不嚴導(dǎo)致“準法律職業(yè)者”的綜合素質(zhì)參差不齊,考試模式及題型設(shè)置不合理,加劇法律職業(yè)人才的短缺,對法學(xué)教育造成的負面影響等問題。針對以上問題,本文在比較分析傳統(tǒng)大陸法系國家法律職業(yè)資格考試制度先進經(jīng)驗的基礎(chǔ)上,就我國統(tǒng)一司法考試制度的發(fā)展與完善提出建議。本文將分三部分進行論述: 第一部分,對我國統(tǒng)一司法考試制度9年實踐中暴露出的不足進行分析。 第二部分,對傳統(tǒng)大陸法系國家法律職業(yè)資格考試制度從報考資格、考試模式和法律職業(yè)培訓(xùn)制度等幾個方面進行了比較分析,以期對我國統(tǒng)一司法考試制度的發(fā)展與完善提供有益的借鑒。 第三部分,針對我國統(tǒng)一司法考試制度及其在實踐中暴露出的不足,在借鑒大陸法系國家法律職業(yè)資格考試制度先進經(jīng)驗的基礎(chǔ)上,對我國統(tǒng)一司法考試制度的發(fā)展與完善提出建議。
[Abstract]:In 2001, the standing Committee of the National people's Congress adopted a resolution amending the Law of the people's Republic of China on judges, the Law of the people's Republic of China on Public prosecutors, and the Law of the people's Republic of China on lawyers, and decided to examine the original initial judges, The initial public procurator examination, the lawyer profession qualification examination withdraws one year, the unified judicial examination is held in 2002. Since then, our country has established the unified legal profession qualification examination system (hereinafter referred to as the unified judicial examination system). The establishment of unified judicial examination system is of epoch-making significance in the history of the rule of law in our country. Its establishment has set up a bridge between legal education and judicial practice, which will lead to the continuous improvement of legal education in our country. The selection of qualified legal talents for the construction of our country's rule of law makes the construction of our legal profession community possible. However, the practice of unified judicial examination shows that: it does not produce the expected effect, but it exposes many shortcomings. For example, the lax requirements for registration conditions lead to the uneven comprehensive quality of "quasi-legal professionals". The examination mode and the question type setting are unreasonable, aggravate the shortage of the legal profession talented person, cause the negative influence to the law education and so on. Based on the comparative analysis of the advanced experience of the legal qualification examination system in the countries of the traditional continental law system, this paper puts forward some suggestions for the development and perfection of the unified judicial examination system in China. The first part analyzes the deficiency of our country's unified judicial examination system in 9 years' practice. In the second part, the author makes a comparative analysis of the legal qualification examination system in the countries of traditional continental law system from the aspects of registration qualification, examination mode and legal vocational training system, etc. In order to provide a useful reference for the development and improvement of the unified judicial examination system in China. The third part, in view of our country unifies the judicial examination system and its in the practice exposes the insufficiency, in drawing lessons from the continental law system country legal profession qualification examination system advanced experience foundation, This paper puts forward some suggestions on the development and perfection of the unified judicial examination system in China.
