【摘要】：社區(qū)矯正心理矯治作為改造社區(qū)服刑人員的重要手段已成為我國(guó)社區(qū)矯正工作中的重要內(nèi)容。隨著最高人民法院、最高人民檢察院、公安部、司法部聯(lián)合制定的《社區(qū)矯正實(shí)施辦法》的出臺(tái)，心理矯治工作更是逐步走上法治化道路。但不可否認(rèn)的是，我國(guó)社區(qū)矯正心理矯治的理論和研究方面還存在諸多不足，，以致心理矯治這一體現(xiàn)國(guó)際行刑改革趨勢(shì)和刑罰人道主義價(jià)值觀的制度優(yōu)勢(shì)還沒(méi)有充分顯現(xiàn)。筆者正是從我國(guó)目前社區(qū)矯正心理矯治理論和實(shí)踐存在的問(wèn)題入手，提出建立符合我國(guó)本土文化的社區(qū)矯正心理矯治制度，使其更好的服務(wù)于我國(guó)刑事司法改革的實(shí)踐。 本文首先論述了我國(guó)社區(qū)矯正心理矯治的含義及理論基礎(chǔ)。深入剖析矯正制度的基本理論觀點(diǎn)，并對(duì)開(kāi)展心理矯治工作的困難進(jìn)行深入分析，在此基礎(chǔ)上提出矯正對(duì)象所享有的基本權(quán)利。同時(shí)對(duì)矯正對(duì)象的常見(jiàn)異常心理現(xiàn)象進(jìn)行介紹并提出常見(jiàn)異常心理的五種病因模式。接著提出社區(qū)矯正心理矯治中應(yīng)當(dāng)遵循的平等、互動(dòng)、保密和個(gè)案矯治五項(xiàng)原則。最后提出構(gòu)建我國(guó)本土化的心理矯治新格局。作為本文的重點(diǎn)，筆者從心理矯治隊(duì)伍的專業(yè)化、專職化入手，依托我國(guó)傳統(tǒng)本土文化中的佛學(xué)文化、結(jié)合中國(guó)人的關(guān)系取向特點(diǎn)與社會(huì)建構(gòu)論心理學(xué)相結(jié)合，提出具有中國(guó)本土特色的心理矯治方法，最后在社區(qū)矯正心理矯治的硬件保障和矯治工作人員工作方法提出有價(jià)值的建議，以完善我國(guó)的社區(qū)矯正心理矯治工作。
[Abstract]:As an important means of reforming community prisoners, community correction has become an important part of community correction. With the development of the Supreme people's Court, the Supreme people's Procuratorate, the Ministry of Public Security, The implementation measures of Community Correction jointly formulated by the Ministry of Justice has made the psychological correction work step by step on the road of rule of law. However, it is undeniable that there are still many deficiencies in the theoretical and research aspects of community correction in China. As a result, psychological correction, which reflects the trend of international execution reform and the institutional advantage of penalty humanitarian values, has not been fully manifested. The author begins with the problems existing in the theory and practice of community correction in China. This paper puts forward the establishment of community correction system in accordance with our native culture so as to better serve the practice of criminal justice reform in our country. This paper first discusses the meaning and theoretical basis of community correction in our country, deeply analyzes the basic theoretical viewpoints of correction system, and analyzes the difficulties of psychological correction. At the same time, it introduces the common abnormal psychological phenomenon of the correction object and puts forward five etiological models of the common abnormal psychology, and then puts forward the correction of community psychological treatment. Equality to be observed, Finally, the author puts forward the construction of a new pattern of localization of psychological treatment in China. As the focus of this paper, the author starts with the specialization and full-time of the psychological correction team. Based on the Buddhist culture in Chinese traditional culture and the relationship orientation of Chinese people and the psychology of social constructivism, the author puts forward the method of psychological correction with Chinese characteristics. Finally, some valuable suggestions are put forward in order to perfect the work of community correction in our country.
