【摘要】：酷吏作為與循吏相對的一個(gè)群體,以執(zhí)法嚴(yán)酷為大眾所知,整個(gè)群體基本上是被大眾否定的,甚至有人認(rèn)為酷吏文化是中國古代法律思想的糟粕,是中華文明史上的污點(diǎn),是完全不可取的,站在今天的角度來看,酷吏確實(shí)是不可取的,但我們研究歷史事件和人物,必須把他們放到其所在的歷史大背景中來考察,來分析。站在歷史的角度來做客觀評價(jià),我認(rèn)為酷吏這個(gè)群體雖然從理想的角度看并不完美,但從現(xiàn)實(shí)的角度看,卻又屬必需。在酷吏的研究方面,前人學(xué)者對漢代酷吏的研究,已經(jīng)有了豐碩的成果,對武周時(shí)期的酷吏,從武則天的角度來分析也有不少學(xué)術(shù)成果。但整體而言,學(xué)者對武則天時(shí)代酷吏研究的深度遠(yuǎn)遠(yuǎn)沒有達(dá)到漢代。學(xué)界鮮有對武周酷吏這一群體做全面的獨(dú)立的分析,大部分是雜糅在武則天酷吏政治的研究里。所以本文截取武周這一特殊時(shí)期,從酷吏與其司法行為的角度來分析武周酷吏的司法行為方式與特征以及其存在的價(jià)值與作用。讓人們對武周時(shí)期的酷吏有一個(gè)全面的認(rèn)識。 第一部分,首先對酷吏概念范圍進(jìn)行界定,得出本文所用“酷吏”的內(nèi)涵,然后分析在古代封建社會(huì)酷吏這個(gè)群體存在的必然性。 第二部分,論述武周時(shí)期出現(xiàn)大量酷吏的歷史背景 第三部分,結(jié)合唐律及《新唐書》、《舊唐書》等史料來分析武周酷吏所擁有的職權(quán),然后分析其職權(quán)運(yùn)作的依據(jù)。 第四部分是整篇論文的重點(diǎn),結(jié)合史料主要論述武周酷吏的具體行為及其特征,從其行為分析出武周酷吏區(qū)別于其它時(shí)期酷吏的特征。 第五部分,講述的是武周酷吏所產(chǎn)生的歷史作用,對其應(yīng)該肯定的歷史作用我們予以積極評價(jià),該否定的就予以批評,不簡單的以利大于弊而肯定,弊大于利而否定。第六部分為結(jié)語。 本文在前人研究成果的基礎(chǔ)上,主要采取歷史文獻(xiàn)研究法、典型個(gè)案分析法及比較研究法,以此考察他們與法律社會(huì)的關(guān)系,透過他們的司法活動(dòng),尋找他們的角色定位。

In the third part , combining the historical materials such as the Tang Dynasty and the Tang Shu Tang and the Old Tang Dynasty , this paper analyzes the functions and powers possessed by the officials in the Zhou Dynasty , and then analyzes the basis of their functions and functions . The fourth part is the focus of the whole thesis , and the combination of historical materials mainly discusses the specific behaviors and characteristics of the officials in the Zhou Dynasty . The fifth part is about the historical role of Zhou officials in the Zhou Dynasty . We should make a positive evaluation on the historical role which should be affirmed , and the negative will be criticized . It is not easy to take advantage of the advantages and disadvantages . The sixth part is divided into the conclusion . Based on the previous research results , this paper mainly adopts historical document research method , typical case analysis method and comparative research method to examine their relationship with the legal society , through their judicial activities , to find their role orientation .
