【摘要】：偵查監(jiān)督是指人民檢察院作為國(guó)家專門的法律監(jiān)督機(jī)關(guān),依法對(duì)偵查機(jī)關(guān)、偵查部門刑事偵查活動(dòng)的合法性進(jìn)行的監(jiān)督,包括立案監(jiān)督,審查逮捕,偵查活動(dòng)監(jiān)督三項(xiàng)職責(zé)。偵查監(jiān)督對(duì)于保證偵查活動(dòng)依法進(jìn)行,切實(shí)保護(hù)公民的合法權(quán)益意義重大。 英美法系和大陸法系國(guó)家偵查監(jiān)督的特點(diǎn)是法官運(yùn)用司法審查權(quán)制約偵查權(quán),同時(shí)賦予了犯罪嫌疑人一系列重要的訴訟權(quán)利,利用權(quán)利來對(duì)抗偵查權(quán),從而有效防止了偵查權(quán)的濫用。 我國(guó)偵查監(jiān)督權(quán)由檢察機(jī)關(guān)行使,但是由于公安、檢察機(jī)關(guān)之間是“互相配合、互相制約”的關(guān)系,檢察機(jī)關(guān)缺乏應(yīng)有的權(quán)威,監(jiān)督軟弱、乏力。偵查監(jiān)督范圍狹窄,強(qiáng)制性措施都沒有納入監(jiān)督的范疇；當(dāng)前主要通過書面審查的方式進(jìn)行監(jiān)督,這種事后、靜態(tài)的監(jiān)督很難發(fā)現(xiàn)問題；監(jiān)督手段沒有剛性,缺乏監(jiān)督實(shí)效；檢察機(jī)關(guān)自偵案件的監(jiān)督屬于自己監(jiān)督自己,監(jiān)督更是流于形式。 鑒于我國(guó)偵查監(jiān)督的現(xiàn)狀以及存在的問題,應(yīng)從以下一些方面加以完善：1、建立“互相配合、引導(dǎo)、控制偵查”的合理關(guān)系,2、擴(kuò)大偵查監(jiān)督的范圍,3、建立刑事立案報(bào)備制度和跟蹤監(jiān)督制度,4強(qiáng)化偵查監(jiān)督措施,建立檢察令狀制度,5、進(jìn)一步完善檢察機(jī)關(guān)自偵案件的偵查監(jiān)督制度,應(yīng)由上一級(jí)檢察機(jī)關(guān)來監(jiān)督,未來的趨勢(shì)是取消自偵案件,回歸監(jiān)督本位。
[Abstract]:Investigation supervision means that the people's Procuratorate, as a special legal supervision organ of the state, supervises the legality of criminal investigation activities of investigation organs and investigation departments according to law, including filing supervision, examining and arresting. Investigation supervision is of great significance to ensure the investigation activities to be carried out according to law and to protect citizens' legitimate rights and interests. The characteristics of investigation supervision in Anglo-American law system and civil law system are that judges use the right of judicial review to restrict the power of investigation, and at the same time give criminal suspects a series of important litigation rights, and use their rights to confront the power of investigation. Thus effectively prevent the abuse of investigation power. The power of investigation and supervision in our country is exercised by the procuratorial organ, but the relationship between the public security and procuratorial organs is "cooperate and restrict each other", and the procuratorial organ lacks the proper authority and the supervision is weak. Weak. The scope of investigation and supervision is narrow, and the compulsory measures are not included in the scope of supervision; At present, the supervision is mainly carried out by the way of written examination. After this, it is difficult to find problems in the static supervision. The means of supervision is not rigid and lacks the actual effect of supervision; The supervision of procuratorial organs'self-investigation cases belongs to their own supervision, and supervision is a mere formality. In view of the present situation and existing problems of investigation supervision in our country, we should perfect the "1: 1" from the following aspects, establish a reasonable relationship of "mutual cooperation, guidance, and control of investigation" and expand the scope of investigation supervision. (3) to establish the system of criminal filing and reporting and the system of tracking and supervising. (4) to strengthen the measures of investigation and supervision, to establish the system of procuratorial writ, and to further improve the system of investigation and supervision of self-investigating cases by procuratorial organs. Should be supervised by the higher procuratorial organs, the future trend is to abolish self-detection cases and return to the supervision standard.
