【摘要】：隨著程序公正的理念深入人心,有關(guān)司法程序的問題正在引起從學(xué)界到實務(wù)界直至整個社會的高度關(guān)注。近年來,司法制度改革將司法程序問題作為切入點,不斷追求司法公正的目標。檢察機關(guān)試行量刑建議制度,就是在司法制度改革的大背景下進行的。從北京市東城區(qū)人民檢察院在全國率先實行量刑建議制度到最高人民檢察院正式將量刑建議制度作為刑事訴訟程序改革的重點內(nèi)容立項以來,在理論界和各地實務(wù)界的不斷探討和實踐下,日益顯現(xiàn)出其“公正和效率”的內(nèi)在要求。 本文首先對量刑建議制度及量刑建議權(quán)的概念及基本屬性進行了介紹,分析了量刑建議制度在世界以及我國的產(chǎn)生及歷史發(fā)展過程,認為量刑建議權(quán)是屬于傳統(tǒng)公訴權(quán)的一部分,有其自身存在的重要價值。其次,通過對其他有代表性的國家和地區(qū)量刑建議制度的考察和比較研究,總結(jié)出量刑建議制度運行的共同規(guī)律,為我國構(gòu)建量刑建議制度提出了一些啟發(fā)。再次,對我國量刑建議試點階段的工作情況進行介紹,雖然所統(tǒng)計的地方量刑建議的采納率都比較高,上訴率和抗訴率都有所下降,但在實踐中仍然凸顯出許多問題,如量刑規(guī)則及標準不明確、忽視對適用簡易程序?qū)徖戆讣牧啃探ㄗh、提出高度概括性建議和對應(yīng)當適用緩刑的被告人不予明確建議等。最后,結(jié)合筆者所在基層檢察院量刑建議的適用情況,提出了在基層檢察院目前的辦案現(xiàn)實下,如何將量刑建議制度很好的加以適用的一些構(gòu)想。由于手中資料的缺乏,以及筆者學(xué)識十分有限等限制,文中很多觀點有不成熟之處,望各位老師多給予批評指正。
[Abstract]:With the support of procedural justice concept, the relevant judicial procedures are being paid high attention from academia to practice until the whole society. In recent years, the reform of the judicial system, judicial procedure as a starting point, the constant pursuit of the goal of justice. The prosecution trial sentencing recommendation system is carried out in the background of the reform of the judicial system the. Since the Beijing City People's Procuratorate of Dongcheng District in the first implementation of the system of sentencing suggestion to the Supreme People's Procuratorate official sentencing suggestion system as the project focus on the reform of criminal procedure, in the continuous exploration and practice of the theory and practice of the country, is showing its inherent requirement of "justice and efficiency".
This paper first introduces the concept of sentencing suggestion system and sentencing suggestion right and basic attributes, analysis of the sentencing suggestion system in the world and China's production and the historical development process, that the power of sentencing suggestion is part of the traditional right of public prosecution, has the important value of its own existence. Secondly, based on other research on behalf of the sentencing suggestion system of countries and regions and comparative research, summarizes the common law of the operation of the proposed system, puts forward some inspiration for constructing the sentencing suggestion system in our country. Thirdly, the sentencing suggestion of the pilot phase of work were introduced, although the adoption of the proposed local sentencing statistics rate is relatively high and the rate of appeal and protest rates have declined, but in practice still highlights many problems, such as unclear sentencing rules and standards, ignoring the application of summary procedures in the trial of the case amount The punishment suggestion, put forward a general proposal and to the defendant on probation shall not clear recommendations. Finally, application of the author's Procuratorate sentencing proposal, put forward in the case of grass-roots procuratorates under the current reality, how to make the proposed system is very good to apply some ideas. Due to the lack of information in the hands. And the author's limited knowledge and other restrictions, the many views are immature, hope that teachers give more criticism.
