【摘要】：法官釋法是司法實踐中普遍存在的現(xiàn)象。但我國是大陸法系國家,現(xiàn)有的立法體系中并不認可法官在個案中創(chuàng)造性地得出判決結(jié)論,因此法官必須從立法宗旨出發(fā),通過文義解釋或論理解釋等方法,得出符合法律效果與社會效果統(tǒng)一的裁判結(jié)果,以實現(xiàn)公平正義。本文分為五個部分:第一部分,法律進行解釋的必要性。法律的有限性、滯后性,文字語義的模糊性,法官職業(yè)的必然性,決定了現(xiàn)行的法律規(guī)定不能完全對應(yīng)復(fù)雜多變的社會現(xiàn)象。因此法官在適用法律的過程中,必然要對成文法的內(nèi)容進行說理性解釋。第二部分,法律解釋的方法。制定法必然不能完全滿足快速發(fā)展的社會需要,當(dāng)某一新型社會關(guān)系出現(xiàn)時,需要運用論理解釋的方法闡明立法本意,以便做出有符合立法精神的判決結(jié)果。另外基于對法律語言的多元化理解,需要運用文義解釋的方法,將某些法律概念予以明確。第三部分,法官進行法律解釋的原則。法官所作的法律解釋以客觀存在的法律文本為對象,其解釋的最終結(jié)果要被社會認可,無論是文義解釋還是論理解釋,其最終都應(yīng)以憲法為根本依據(jù),符合憲法規(guī)定的立法宗旨和目的,其結(jié)果體現(xiàn)法治精神。第四部分,法官法律解釋的特點。法官的法律解釋權(quán)貫穿在司法實踐的整個過程中,包含著法官對某一法律規(guī)定的價值判斷和衡量,其得出的解釋結(jié)果對判決結(jié)果負責(zé),具有獨斷性。第五部分,法官法律解釋的權(quán)利制約與保障。建立法律職業(yè)群體的理性商談機制,為法官的法律解釋提供理性的建議,并運用多元化的解釋方法,使法官的解釋體現(xiàn)法治精神及立法本意,當(dāng)然法官的法律解釋需要有文本的規(guī)范性制約,也需要對法官的解釋建立監(jiān)督機制。
[Abstract]:Judge interpretation is a common phenomenon in judicial practice, but China is a civil law country, the existing legislative system does not recognize judges in the case of creative conclusion. Therefore, the judge must proceed from the legislative purpose, through the interpretation of literary meaning or the interpretation of reasoning and other methods, to achieve the legal effect and social effect of the unity of the adjudication results. In order to achieve fairness and justice, this paper is divided into five parts: the first part, the necessity of interpretation of the law, the limitation of the law, lag, the fuzziness of the meaning of the text, the inevitability of the profession of judges. It is decided that the current legal provisions can not completely correspond to the complex and changeable social phenomena. Therefore, in the process of applying the law, judges must explain the content of statutory law rationally. The second part. The method of legal interpretation. Statutory law must not fully meet the needs of the rapidly developing society. When a new type of social relationship appears, it is necessary to use the method of argumentation to clarify the legislative intent. In order to make a decision in line with the spirit of legislation. In addition, based on the pluralistic understanding of the legal language, it is necessary to use the method of literal interpretation to clarify some legal concepts. Part three. The principle of the judge's legal interpretation. The judge's legal interpretation takes the objective legal text as the object, and the final result of its interpretation should be recognized by the society, whether it is the interpretation of literary meaning or the interpretation of reasoning. Finally, it should be based on the Constitution, in line with the legislative purposes and objectives stipulated in the Constitution, and its results reflect the spirit of the rule of law. 4th part. Judge's power of legal interpretation runs through the whole process of judicial practice, including the judge's value judgment and measurement of a certain law, and the result of interpretation is responsible for the result of judgment. Part 5th, the right restriction and guarantee of judges' legal interpretation, establishes the rational negotiation mechanism of the legal profession groups, provides rational advice for the judges' legal interpretation, and uses the pluralistic interpretation methods. In order to make the judge's interpretation reflect the spirit of the rule of law and the original intention of legislation, of course, the judge's legal interpretation needs the normative restriction of the text, and also needs to establish the supervision mechanism to the judge's interpretation.
