本文主要從語用學角度對律師辯護詞中情態(tài)的選擇進行了研究。旨在通過對30篇公開發(fā)行的各類律師辯護詞的描述性分析,發(fā)現(xiàn)常用情態(tài)的類型和律師選擇特定情態(tài)的動機,并揭示情態(tài)是如何實現(xiàn)其說服作用的。 本文的理論框架是以Verschueren的順應論為基礎(chǔ),在分析語料的基礎(chǔ)上建立起來的。在此理論框架下情態(tài)被解釋為,對命題或者句子結(jié)構(gòu)起到修飾或者潤色的各種語義成分,可以表達肯定或者懷疑的程度、模糊性、可能性、必要性、許可和義務等可以表達對話語態(tài)度的一類語義成分。結(jié)合彭宣維和Halliday對情態(tài)的劃分,考慮到律師語言的特色,我們把情態(tài)分為三類:評論附加情態(tài)、情態(tài)動詞和語氣附加語、情態(tài)的混合用法。 首先通過對情態(tài)類型使用的頻數(shù)分析,我們發(fā)現(xiàn)情態(tài)的使用占到語料的44.7%,其中評論附加語的出現(xiàn)頻數(shù)為12.9%。其次,我們從心理因素和社會因素角度對情態(tài)的說服功能作了順應分析。以上分析表明情態(tài)可用來順應法官對辯護詞的評價和正確理解,提高辯護詞的客觀性,體現(xiàn)律師對某一事件的態(tài)度,維護保全律師的信譽度。 我們希望,本文的研究能有助于加深對情態(tài)的理解,認識情態(tài)對于實現(xiàn)說服的作用;有助于順應...
