本文意圖通過以話語話題為分析單位對中國法庭刑事審判訊問階段的話題組織進(jìn)行分析,突顯話題分析作為一種話語分析方法的作用,揭示話題分析在分析法庭審判話語中的實(shí)用價值。并期望通過實(shí)例分析,得出某些對中國法庭審判具有參考性的意見。 國內(nèi)有關(guān)話題的研究大多限于探討句法話題,即將話題作為句法成分或語法成分來研究。有關(guān)話語話題,即在超句層面上研究話題的文章并不多見。而國外學(xué)者將話語話題作為分析單位來分析話語取得了不少具有實(shí)用價值的發(fā)現(xiàn)。 本文借助于Jan Svennevig分析日常會話就話題談?wù)摰乃捻椩瓌t,以描述性和解釋性相結(jié)合的方法,分析了轉(zhuǎn)寫的兩場中國刑事審判訊問階段中話題的組織。 文章第一部分通過回顧,總結(jié)國內(nèi)外已有的研究,揭示了話題分析在各個領(lǐng)域,尤其是法律語言學(xué)中的作用,指出了國內(nèi)在此研究領(lǐng)域的不足。文章第二部分簡要介紹了本文的研究方法,所用語料的來源及相關(guān)內(nèi)容。第三部分探討了中國刑審訊問階段話語話題所具備的特征,并由此界定了相關(guān)的術(shù)語:程序性話題,實(shí)體性話題,上層話題和基層話題,為下文主體部分的論述打下了基礎(chǔ)。文章第四部分論述了刑審訊問階段話題組織的三個方面:話題的導(dǎo)入...
