鑒于證人證言在刑事案件審理中的重要性,本文試圖研究警察詢(xún)問(wèn)階段證人語(yǔ)言的特點(diǎn),著重于其中銜接手段的使用。證人借助于銜接手段的使用,使證詞具有更強(qiáng)的一致性、相關(guān)性、邏輯性等,因而提高證詞的可信度。 本文擬從關(guān)聯(lián)理論的角度出發(fā),根據(jù)關(guān)聯(lián)假設(shè)及關(guān)聯(lián)原則來(lái)分析銜接手段在證人語(yǔ)言中的選擇與使用。詢(xún)問(wèn)作為證人與警察之間的一種交際是一個(gè)明示—推理過(guò)程。從證人角度來(lái)說(shuō)是一種明示過(guò)程,而根據(jù)關(guān)聯(lián)原則,每一個(gè)明示的交際行為應(yīng)設(shè)想為本身具有最佳關(guān)聯(lián)性,即同等條件下語(yǔ)境效果越大,付出的努力越小,關(guān)聯(lián)性就越強(qiáng)。在明示過(guò)程中證人借助于明示刺激—銜接手段的使用以達(dá)到此目的。 根據(jù)從法院收集的警察詢(xún)問(wèn)筆錄及本文構(gòu)建的理論框架,主要解決兩個(gè)問(wèn)題:1.證人在證言中是如何選擇使用不同的銜接手段以及在這一特定的語(yǔ)境下銜接手段的特點(diǎn)。2.他們?nèi)绾瓮ㄟ^(guò)運(yùn)用這些銜接手段來(lái)增強(qiáng)證言的可信度。通過(guò)對(duì)這兩個(gè)問(wèn)題的分析,我們可以得出這樣的結(jié)論:關(guān)聯(lián)理論可以解釋證人語(yǔ)言中銜接手段的選擇與使用。因?yàn)楸疚难芯康膶?duì)象是證人語(yǔ)言,因而著重的是從證人角度來(lái)探討明示這一過(guò)程。至于他們有意運(yùn)用的這些語(yǔ)言策略是否達(dá)到他們意想的效果,是否有助于減...
