【摘要】：在今天的法學(xué)研究方法中,階級(jí)分析方法已經(jīng)較少得到應(yīng)用,甚至有人使用"衰落"一詞來形容它。但從馬克思和恩格斯的私法思想角度觀察,在私法學(xué)中使用階級(jí)分析方法,仍然可以發(fā)現(xiàn)階級(jí)分析方法的生命力和有效性。當(dāng)然,在私法學(xué)中運(yùn)用階級(jí)分析方法,不能將它視為唯一的研究方法,同時(shí)還必須注意區(qū)分階級(jí)性私法關(guān)系與非階級(jí)性私法關(guān)系的不同,也不能將私法主體之間的"斗爭(zhēng)"認(rèn)定為階級(jí)斗爭(zhēng)。
[Abstract]:In today's legal research methods, class analysis methods have been rarely used, and some people even use the word "decline" to describe it. However, from the point of view of Marx and Engels' thought of private law, the vitality and effectiveness of class analysis method can still be found by using class analysis method in private law. Of course, the use of class analysis in private law can not be regarded as the only research method. At the same time, attention must be paid to distinguishing the difference between class private law and non-class private law, and the "struggle" between private law subjects can not be regarded as class struggle.
