【摘要】：與宋朝發(fā)達的社會救濟事業(yè)相一致,宋朝的社會救濟法律同樣在中國法制史上占有重要地位。其不僅體系完備,明確規(guī)定了救濟對象、救濟機構(gòu)、救濟內(nèi)容與程序、救濟方法、救濟的經(jīng)費保障與救濟管理規(guī)范,而且內(nèi)容周詳具體,有很強的可操作性,同時還比較機動靈活,能夠適時調(diào)整。宋朝社會救濟法之所以如此發(fā)達,是有多重原因促成的,其中儒家文化的熏染、經(jīng)濟發(fā)展的促進、維持社會控制的需要無疑是重要推動因素。
[Abstract]:Consistent with the developed social relief cause of Song Dynasty, the social relief law of Song Dynasty also played an important role in the history of Chinese legal system. It not only has a complete system, but also clearly stipulates the relief object, relief organization, relief content and procedure, relief method, relief fund guarantee and relief management standard, and the content is detailed and specific, it has strong maneuverability, at the same time, it is more flexible and can be adjusted at the right time. There are many reasons why the social relief law of Song Dynasty is so developed, among which the influence of Confucian culture, the promotion of economic development and the need to maintain social control are undoubtedly important driving factors.
