【摘要】： 信息時代的浪潮正席卷著我們每一個人的生活,改變著我們的生活方式,也改變著彼此之間的聯(lián)系。各種網(wǎng)絡在拉近世界距離的同時,也帶來了表達自由的革命。在這個知識爆炸、瘋狂叫囂權利的時代,人類已經(jīng)不滿足于“我不同意你的觀點,但我誓死捍衛(wèi)你說話的權利”,人類在各種網(wǎng)絡的連接下,正在尋求一種嶄新的表達方式,要求更加平等化、多元化、民主化、自我化的表達自由。傳統(tǒng)的表達自由理論在先進的傳播渠道、嶄新的表達方式面前已經(jīng)不能很好地繼續(xù)引導我們前進的方向,表達自由更不應該僅僅是停留在“紙上的權利”。 本文第一部分首先對表達自由的內(nèi)涵、特征作了釋義,在經(jīng)過對自由的論證、傳統(tǒng)理論中對表達自由內(nèi)涵及外延的界定之后,又對表達自由的屬性作了概括。之后對信息時代下表達自由表現(xiàn)出的新特征以及信息時代下表達自由的價值作了詳細闡述。第二部分對表達自由的時代進程作了梳理,分為萌芽、確立與初步發(fā)展以及蓬勃發(fā)展三個階段,詳細敘述了表達自由的發(fā)展歷史。文章第三部分從兩個案例和一種現(xiàn)象著手,分析了信息時代下表達方式與手段的變化、法律規(guī)定的茫然、與其他權利的沖突以及全球化帶來的挑戰(zhàn)。文章第四部分是關于表達自由的實現(xiàn),分別從限制和保障兩方面入手,先對表達自由的限制依據(jù)和相關界線進行探討,進而從法律保障、行政保障、技術保障和行業(yè)自律三個不同角度進行了剖析,以期能使表達自由的保障路徑更趨清晰化。文章的最后一部分是對表達自由發(fā)展前景的展望,我們堅信在不久的將來,對表達自由的保護將更加的規(guī)范,作為一項權利,它離我們將越來越近。 表達自由是我們最應珍視的基本權利,其深厚的文化內(nèi)涵和亙古不變的人文情懷是我們孜孜追求的永恒價值。文章力求能使這種追求貫穿于始終,更期盼表達自由能引起人們更多的重視。
[Abstract]:The tide of the information age is sweeping the lives of each of us, changing our way of life, and changing the links between them. The various networks, while bringing the world away, have also brought a revolution to freedom of expression. In the era of the explosion of knowledge and the crazy clamoring of rights, human beings have not been satisfied with the "I don't agree with you, but I'm committed to defending your right to speak.". In the connection of various networks, mankind is seeking a brand-new expression, which requires more equality, pluralism, democratization and self-expression. The traditional expression of freedom theory in the advanced communication channel, the new way of expression has not been able to continue to guide us in the forward direction, the expression of freedom should not only be in the "Rights on paper". In the first part of this paper, the connotation and characteristics of the freedom of expression are firstly explained. After the definition of freedom, the definition of the free connotation and the extension of the expression in the traditional theory is also made. After that, the new characteristics of the expression of freedom in the information age and the value of the expression of freedom in the information age are discussed. The second part sorts out the time course of freedom of expression, which is divided into three stages: the germination, the establishment and the preliminary development and the vigorous development, and the development of the freedom of expression is described in detail.
