【摘要】： 社會法起源于西方資本主義社會,以國家壟斷資本主義時期出現(xiàn)的社會矛盾為時代背景,以實質(zhì)正義理論、社會連帶責任思想等學(xué)說為思想基礎(chǔ)而產(chǎn)生。社會法在歐美以及日本發(fā)展歷史悠久,其中德國最早建立完善的社會法體制。社會法范疇如何界定的問題一直處于爭議之中,筆者以公民社會權(quán)的保障和實現(xiàn)為進路將社會法定義在部門法的層次上,并對目前流行的“社會法就是第三法域”以及狹義社會法概念從反面進行分析。在此基礎(chǔ)上,對社會法和經(jīng)濟法的關(guān)系展開初步探討,認為它們雖然存在一定的共性,但又是相互獨立、相互配合的法律部門。本文運用歷史考察和比較的方法對社會法的起源和發(fā)展進行闡述,關(guān)注的是社會法在我國未來的走向。
[Abstract]:Social law originates from western capitalist society, takes the social contradiction that appeared in the period of state monopoly capitalism as the background of the times, and takes the theory of substantive justice and the thought of social joint and several liability as the ideological basis. Social law has a long history in Europe and the United States and Japan, among which Germany first established a perfect social law system. The question of how to define the category of social law has always been controversial. The author defines social law at the level of departmental law by taking the protection and realization of civil social rights as the way, and analyzes the popular "social law is the third jurisdiction" and the concept of narrow social law from the opposite side. On this basis, the relationship between social law and economic law is discussed, and it is considered that although they have certain commonalities, they are independent and cooperative legal departments. This paper expounds the origin and development of social law by means of historical investigation and comparison, and pays attention to the future trend of social law in our country.
