【摘要】： 隨著改革開放的深化,我國對外貿(mào)易發(fā)展飛速,取得了巨大成績,涉及的領(lǐng)域也在不斷擴(kuò)大,因此,建立完善的外貿(mào)法律制度顯得至關(guān)重要。俄羅斯作為世界上重要的經(jīng)濟(jì)貿(mào)易大國,與我國的新疆、東北地區(qū)相鄰,而且與我國一樣都經(jīng)歷了從社會(huì)主義中央計(jì)劃經(jīng)濟(jì)向市場經(jīng)濟(jì)獨(dú)特的轉(zhuǎn)型,只不過我國仍然以公有制為基礎(chǔ),而俄羅斯的社會(huì)主義性質(zhì)已經(jīng)發(fā)生改變,在這樣的情況下,研究兩國的外貿(mào)法律制度,特別是俄羅斯在激進(jìn)式的經(jīng)濟(jì)轉(zhuǎn)軌中建立的外貿(mào)法律制度,有助于進(jìn)一步完善我國的外貿(mào)法律制度,提高我國整體經(jīng)濟(jì)貿(mào)易水平,擴(kuò)大雙邊貿(mào)易。 本文是在國內(nèi)研究外貿(mào)法律制度的基礎(chǔ)上,運(yùn)用實(shí)證分析的方法及法社會(huì)學(xué)的方法,對中國與俄羅斯對外貿(mào)易法律制度從市場準(zhǔn)入、貿(mào)易救濟(jì)、促進(jìn)措施三個(gè)方面進(jìn)行比較研究,通過比較研究,發(fā)現(xiàn)中國與俄羅斯外貿(mào)法律制度的相似之處,不同之處;從中汲取俄羅斯外貿(mào)立法的經(jīng)驗(yàn)與教訓(xùn),借鑒其外貿(mào)法律制度的有益部分,進(jìn)而為中國加入世貿(mào)組織后外貿(mào)易法律制度的完善提供啟示。
[Abstract]:With the deepening of reform and opening up, China's foreign trade has developed rapidly, made great achievements, and the fields involved are also expanding. Therefore, it is very important to establish a perfect legal system of foreign trade. Russia, as an important economic and trade country in the world, is adjacent to Xinjiang and Northeast China, and has experienced a unique transformation from socialist centrally planned economy to market economy, except that our country is still based on public ownership, and the socialist nature of Russia has changed. Under such circumstances, we should study the legal systems of foreign trade between the two countries. In particular, the foreign trade legal system established by Russia in the course of radical economic transition is helpful to further improve China's foreign trade legal system, improve the overall economic and trade level of our country, and expand bilateral trade. On the basis of studying the legal system of foreign trade in China, this paper makes a comparative study on the legal system of foreign trade between China and Russia from three aspects: market access, trade relief and promotion measures by using the methods of empirical analysis and sociology of law. Through the comparative study, it is found that the legal systems of foreign trade between China and Russia are similar and different. This paper draws lessons from the experience and lessons of Russian foreign trade legislation, draws lessons from the beneficial parts of its foreign trade legal system, and then provides enlightenment for the perfection of foreign trade legal system after China's entry into WTO.
