俄羅斯憲法解釋制度研究

【摘要】： 憲政的基本要求是權(quán)力在平等的基礎(chǔ)上進行相互的監(jiān)督與制衡,保障人民能夠制約政府的權(quán)力,保證權(quán)力的行使能符合人民的根本利益,而這就需要一種制度來實施憲法、維護憲政制度、制約政府權(quán)力。憲法解釋制度是為解決憲法實施中憲法與社會生活沖突而采取的一種手段,它作為保障憲法實施、維護憲政、制約權(quán)力的一種制度,為現(xiàn)代國家的法治建設(shè)發(fā)揮著重要作用。 當今俄羅斯的憲法解釋機構(gòu)通過一系列的憲法解釋決議完善了俄羅斯的憲法,保障了憲法的實施、維護了憲法的最高法律地位。中國的法治進程需要積極吸取國外的法治經(jīng)驗,俄羅斯的法律制度正處于發(fā)展階段,中國也正處于改革中,都深切的感受到法律的必要性和重要性。因此對于俄羅斯的法律制度應(yīng)進一步深入研究,有必要開展中國與俄羅斯在法律領(lǐng)域的比較性研究。我國迄今為止尚未真正確立起憲法解釋制度,只有在我國真正建立起憲法解釋制度,我國的憲法實施才能步入憲政軌道。同處于社會改革階段的中國和俄羅斯有相當多可以相互借鑒的地方,俄羅斯憲法解釋制度的成功經(jīng)驗對于將來建立符合我國國情與實踐的憲法解釋制度應(yīng)該會有所價值。 本文的具體任務(wù)是研究俄羅斯的憲法解釋制度,主要包括俄羅斯憲法解釋的概念、特征、目的、程序,并分析和探討聯(lián)邦憲法法院的憲法解釋實踐與聯(lián)邦主體憲法(憲章)解釋的理論與實踐等內(nèi)容。 本文具體分為以下幾個章節(jié)進行論述： 導(dǎo)言：主要介紹憲法解釋的必要性和俄羅斯憲法解釋制度建立的背景,并引出本文研究的主要任務(wù)與目的。 第一章：俄羅斯聯(lián)邦憲法法院憲法解釋制度述評,在該部分筆者將分析憲法法院的解釋程序、判決形式等理論問題,并通過具體的案件對聯(lián)邦憲法法院的憲法解釋實踐進行深入的分析和探討。 第二章：俄羅斯聯(lián)邦主體憲法(憲章)解釋制度述評,在該部分筆者將介紹俄羅斯聯(lián)邦主體憲法(憲章)解釋制度的理論、實踐及存在的問題。 第三章：俄羅斯憲法解釋制度的啟示,在此筆者將對俄羅斯的憲法解釋制度進行總結(jié)并分析其經(jīng)驗與得失,并提出對我國的借鑒意義。
[Abstract]:The basic requirement of constitutionalism is to supervise and balance each other on the basis of equality, to ensure that the people can restrict the power of the government, to ensure that the exercise of power is in line with the fundamental interests of the people, and this requires a system to implement the constitution. Safeguard the constitutional system and restrict the power of the government. The system of constitutional interpretation is a means to solve the conflict between constitution and social life in the implementation of constitution. It plays an important role in the construction of rule of law in modern countries, as a system to guarantee the implementation of constitution, maintain constitutionalism and restrict power. At present, the Russian constitutional interpretation institution has perfected the Russian constitution through a series of constitutional interpretation resolutions, guaranteed the implementation of the constitution, and maintained the highest legal status of the constitution. China's rule of law process needs to actively absorb foreign legal experience, Russia's legal system is in the stage of development, China is also in the process of reform, are deeply aware of the necessity and importance of the law. Therefore, the legal system of Russia should be further studied, and it is necessary to carry out the comparative study between China and Russia in the field of law. So far, the system of constitutional interpretation has not really been established in our country. Only if the system of constitutional interpretation is established in our country, the implementation of the constitution of our country can enter the track of constitutionalism. With China and Russia in the stage of social reform there are a lot of places to learn from each other. The successful experience of the Russian constitutional interpretation system should be valuable for the future establishment of the constitutional interpretation system in accordance with the national conditions and practice of our country. The specific task of this paper is to study the system of Russian constitutional interpretation, mainly including the concept, characteristics, purpose and procedure of Russian constitutional interpretation. It also analyzes and discusses the practice of constitutional interpretation of the Federal Constitutional Court and the theory and practice of the interpretation of the main constitution (Charter) of the Federation. This paper is divided into the following chapters: introduction: mainly introduces the necessity of constitutional interpretation and the background of the establishment of Russian constitutional interpretation system, and leads to the main tasks and objectives of this study. Chapter one: a review of the interpretation system of the Constitution of the Constitutional Court of the Russian Federation. In this part, the author will analyze the theoretical issues of the interpretation procedure and the form of the judgment of the Constitutional Court. And through the specific cases of the Federal Constitutional Court's constitutional interpretation of the practice of in-depth analysis and discussion. Chapter two: a commentary on the interpretation system of the main Constitution of the Russian Federation (Charter). In this part, the author will introduce the theory, practice and existing problems of the interpretation system of the main Constitution of the Russian Federation (Charter). The third chapter: the enlightenment of the Russian constitutional interpretation system, in which the author will summarize the Russian constitutional interpretation system and analyze its experience, gains and losses, and put forward the significance for reference to our country.
