【摘要】： 授權(quán)立法制度在社會(huì)的歷史舞臺(tái)上起到了極其重要的作用,現(xiàn)今社會(huì)仍然存在并發(fā)揮著作用足可見(jiàn)其重要地位。國(guó)內(nèi)外很多學(xué)者都對(duì)其進(jìn)行了研究,并從不同角度進(jìn)行闡述。本文筆者也通過(guò)比較分析各國(guó)學(xué)者的觀點(diǎn)和學(xué)術(shù)研究,在此基礎(chǔ)上提出了自己的觀點(diǎn),全文以授權(quán)立法的概念為基點(diǎn),因?yàn)槲覈?guó)目前各學(xué)者對(duì)何為授權(quán)立法這一術(shù)語(yǔ),仍未作出精確的表述,所以本文一方面澄清何為授權(quán)立法,本文筆者通過(guò)比較研究各學(xué)者對(duì)于這一理論概念的研究成果,又從自身的研究對(duì)其進(jìn)行了定義。本文筆者通過(guò)對(duì)不同歷史時(shí)期授權(quán)立法的特征和內(nèi)涵進(jìn)行定義,這樣有助于理解和對(duì)后文的闡述;另一方面對(duì)于整體授權(quán)立法制度進(jìn)行完善和構(gòu)建,從歷史發(fā)展到現(xiàn)狀再談到其不足,在這部分里,筆者從我國(guó)的歷史發(fā)展分析了授權(quán)立法的產(chǎn)生和發(fā)展以及在此過(guò)程中出現(xiàn)的相應(yīng)的問(wèn)題和不足;最后,本文筆者通過(guò)分析授權(quán)立法制度現(xiàn)狀引出對(duì)授權(quán)立法制度的完善,在這部分里對(duì)授權(quán)立法制度整體進(jìn)行了完善,并對(duì)其中的重要環(huán)節(jié)監(jiān)督進(jìn)行了相關(guān)制度的可行性分析,并提出相應(yīng)的制度的建構(gòu)以保障授權(quán)立法制度的順利進(jìn)行,這部分筆者主要是根據(jù)中外的研究方式,對(duì)外國(guó)的借鑒,和改革我國(guó)的監(jiān)督模式及相關(guān)制度的構(gòu)建進(jìn)行闡述。
[Abstract]:The legislative system of authorization plays a very important role in the historical stage of society, and it still exists and plays an important role in today's society. Many domestic and foreign scholars have carried on the research to it, and from the different angle carries on the elaboration. Based on the comparative analysis of the views and academic research of scholars from all over the world, the author puts forward his own point of view. The full text is based on the concept of authorizing legislation, because what is the term of authorizing legislation is the term of various scholars in our country at present. This paper clarifies what authorization legislation is, on the one hand, the author makes a comparative study of the research results of the theoretical concept of this theoretical concept, and defines it from his own research on the basis of the fact that this paper clarifies the legislation of authorization on the one hand, and the other hand, on the other hand. In this paper, the author defines the characteristics and connotation of authorization legislation in different historical periods, which is helpful to understand and explain the later. On the other hand, to perfect and construct the overall legislative system of authorization, from the historical development to the present situation and then to its shortcomings, in this part, From the historical development of our country, the author analyzes the emergence and development of authorizing legislation and the corresponding problems and deficiencies in this process. Finally, through the analysis of the status quo of the authorization legislation system, the author leads to the perfection of the authorization legislation system, and in this part, the whole authorization legislation system is improved, and the feasibility analysis of the relevant system is carried out on the important links of the authorization legislation system. And put forward the corresponding system construction in order to ensure the smooth progress of the authorization legislation system, this part of the author is mainly based on the Chinese and foreign research methods, reference to foreign countries, and reform of China's supervision model and the construction of the relevant system.
