【摘要】： 商鞅法律思想中成熟的社會(huì)控制理論是商鞅變法取得成功的主要原因。商鞅在以歷史進(jìn)化觀和自利人性論為理論基礎(chǔ),圍繞驅(qū)民農(nóng)戰(zhàn)、富國(guó)強(qiáng)兵的控制目標(biāo),構(gòu)建起以法為主、以俗為輔的社會(huì)規(guī)范體系的同時(shí),還提出一套以刑賞、普法、愚民為基本實(shí)現(xiàn)方式的社會(huì)控制運(yùn)行機(jī)制,并建立一個(gè)高質(zhì)高效的社會(huì)官僚機(jī)構(gòu)保證社會(huì)控制的順利實(shí)施。商鞅的社會(huì)控制理論不僅對(duì)其身后兩千余年的中國(guó)封建統(tǒng)治產(chǎn)生重大影響,時(shí)至今日,拋卻歷史的局限,其中富含的合理成分對(duì)當(dāng)今社會(huì)控制理論體系的完善仍具重要的參考意義。
[Abstract]:The mature social control theory in Shang Yang's legal thought is the main reason for the success of Shang Yang's transformation. Based on the view of historical evolution and the theory of self-interest human nature, Shang Yang constructed a social norm system based on law and vulgarity, focusing on the objective of exorcist farming war and the control of rich country and strong soldiers. At the same time, Shang Yang also put forward a set of criminal reward, popularizing the law. The simple people are the basic mode of social control operation mechanism, and establish a high-quality and efficient social bureaucracy to ensure the smooth implementation of social control. Shang Yang's theory of social control not only had a significant impact on the feudal rule of China for more than two thousand years behind him, but to this day, he has abandoned the limitations of history. The reasonable components are still of great reference significance to the perfection of the social control theory system.
