【摘要】：敦煌唐代民間契約(簡稱民契)的數量非�？捎^,其中包括大量借貸契約。通過對它的考察,再聯(lián)系唐代的官方法律(簡稱官法)發(fā)現:唐代的官法對民契既有所為,更有所不為,既有體系性的規(guī)范,更對民契的獨立自治留下了空間;而民間則堅信:"官有政法,民從私契",民契具有高度的獨立性與自治性,并設法規(guī)避或抵御官法。官法與民契形成了良性互動的格局。探討唐代官法對民間私契的寬容態(tài)度,對于今天國家處理由民間借貸而自發(fā)形成的融資秩序也有借鑒意義。
[Abstract]:Dunhuang Tang Dynasty folk contract (abbreviated as civil deed) is very considerable, including a large number of loan contracts. Through the investigation of it, then connecting with the official law of Tang Dynasty (official law for short), we find that the official law of Tang Dynasty not only has something to do with the deed of the people, but also has some systematic norms and leaves space for the independent autonomy of the deed of the people; On the other hand, the people firmly believe that "the government has the political law, the people follow the private deed", the civil deed has a high degree of independence and autonomy, and tries to circumvent or resist the official law. The official law and the deed of the people formed the pattern of benign interaction. The discussion on the tolerant attitude of the official law of Tang Dynasty to the private deed is also of reference significance for the state to deal with the financing order spontaneously formed by the folk lending.
