【摘要】： 本文受優(yōu)選論及Vijay Bhatia教授的應(yīng)用體裁分析的研究啟示,對(duì)中國(guó)判決書(shū)中譯英中存在的語(yǔ)用充實(shí)現(xiàn)象進(jìn)行研究。翻譯中的語(yǔ)用充實(shí)是指譯者首先借助充實(shí)對(duì)原文進(jìn)行全面、深刻的理解,接著再把這種充分的理解在目的語(yǔ)翻譯中體現(xiàn)出來(lái)。根據(jù)譯者對(duì)句子中不同成分的充實(shí)的結(jié)果,本文將語(yǔ)用充實(shí)分成以下幾個(gè)類(lèi)別并分別舉例說(shuō)明。文中的語(yǔ)用充實(shí)包括:指示類(lèi)、概念類(lèi)、主題類(lèi)、語(yǔ)篇銜接類(lèi)、含義類(lèi)、法律解釋類(lèi)語(yǔ)用充實(shí)。 本文中構(gòu)建的理論框架主要受優(yōu)選論啟示。優(yōu)選論的核心思想是在看待某一現(xiàn)象時(shí),它包括了一系列的限制條件來(lái)評(píng)判一些候選項(xiàng),直到評(píng)選出最佳候選項(xiàng)。在這樣的理論影響下,并結(jié)合Vijay Bhatia教授關(guān)于應(yīng)用體裁分析的理論框架,本文選擇了以下四個(gè)翻譯限制條件來(lái)分析中國(guó)判決書(shū)翻譯中的語(yǔ)用充實(shí)現(xiàn)象。這四個(gè)限制條件分別為:文本限制、體裁限制、專(zhuān)業(yè)操作限制以及專(zhuān)業(yè)文化限制。本文的研究重點(diǎn)就是運(yùn)用以上這四個(gè)限制條件來(lái)分析、評(píng)價(jià)中國(guó)判決書(shū)翻譯中語(yǔ)用充實(shí)現(xiàn)象的合適性,并能夠?yàn)橹袊?guó)判決書(shū)翻譯質(zhì)量的提高,乃至中國(guó)法律翻譯研究做一定貢獻(xiàn)。
[Abstract]:In this paper, the pragmatic enrichment phenomenon in the translation of Chinese judgments into English is studied, which is enlightened by the study of the application genre analysis by Professor Vijay Bhatia. Pragmatic enrichment in translation refers to the translator's comprehensive and profound understanding of the original text by means of enrichment, and then reflects this full understanding in the target language translation. According to the results of the translator's enrichment of the different elements in the sentence, this paper divides pragmatic enrichment into the following categories and illustrates them with examples. Pragmatic enrichment includes demonstrative class, conceptual class, subject class, textual cohesion class, implicature class and pragmatic enrichment of legal interpretation class. The theoretical framework constructed in this paper is mainly enlightened by the theory of optimization. The core idea of optimization theory is that when it looks at a phenomenon, it includes a series of constraints to judge some candidates until the best candidate is selected. Under the influence of this theory, and in combination with Professor Vijay Bhatia's theoretical framework of applied genre analysis, this paper chooses the following four translation constraints to analyze pragmatic enrichment in Chinese judgement translation. The four restrictions are text restriction, genre restriction, professional operation restriction and professional culture restriction. The research focus of this paper is to analyze and evaluate the appropriateness of pragmatic enrichment in the translation of Chinese judgments and to improve the quality of translation of judgments in China by using the above four constraints to analyze and evaluate the appropriateness of pragmatic enrichment in the translation of judgments in China. Some contributions have been made to the study of legal translation in China.
