【摘要】：地方立法是我國(guó)立法的重要內(nèi)容,我國(guó)地方立法存在缺乏必要性、具體性、越權(quán)嚴(yán)重、沖突廣泛、操作性差等問(wèn)題;這些問(wèn)題導(dǎo)致大量立法資源被浪費(fèi),不利于法的價(jià)值的實(shí)現(xiàn)、社會(huì)主義法制的統(tǒng)一、法律作用的實(shí)現(xiàn),法律適用無(wú)所適從、地方保護(hù)主義合法化。地方立法存在問(wèn)題的原因主要是地方立法目的不當(dāng)、立法主體立法技術(shù)的欠缺、地方立法主體觀念滯后、立法依據(jù)不明、相應(yīng)的國(guó)家機(jī)關(guān)怠于履行立法監(jiān)督職責(zé)。解決地方立法問(wèn)題的出路在于端正立法目的、更新立法觀念、實(shí)行立法專(zhuān)業(yè)化、明確地方立法依據(jù)、強(qiáng)化立法監(jiān)督責(zé)任,建立地方立法"良法"標(biāo)準(zhǔn)等。
[Abstract]:Local legislation is an important part of legislation in our country. There are some problems in local legislation such as lack of necessity, concreteness, serious over-power, widespread conflict and poor operability. These problems lead to the waste of a large number of legislative resources, which is not conducive to the realization of the value of the law, the unification of the socialist legal system, the realization of the role of the law, the indecision of the application of law and the legalization of local protectionism. The existing problems of local legislation are mainly due to the improper purpose of local legislation, the lack of legislative technology of the legislative subject, the lag of the concept of the subject of local legislation, the unclear legislative basis, and the neglect of the corresponding state organs to perform their duties of legislative supervision. The way out to solve the local legislation problem is to correct the legislative purpose, renew the legislative concept, carry out the specialization of the legislation, clarify the basis of the local legislation, strengthen the responsibility of legislative supervision, and establish the standard of "good law" of the local legislation and so on.
