試析立法過程中的利益博弈

【摘要】： 轉(zhuǎn)型時(shí)期的中國正面臨更加復(fù)雜和多樣的社會(huì)問題,核心問題是日益表面化的利益博弈。在過去,由于我國高度集中的中央集權(quán)體制,立法權(quán)高度集中于中央,強(qiáng)調(diào)國家利益的一致性和至高性,博弈機(jī)制沒有適合其發(fā)展的土壤。近三十年來,利益主體多元化的形成,逐漸造成了由利益博弈來擔(dān)當(dāng)正義分配的機(jī)制之勢(shì),表現(xiàn)為從政策博弈向立法博弈的轉(zhuǎn)型,其實(shí)質(zhì)是利益博弈的法制化。利益博弈進(jìn)入立法領(lǐng)域,是旨在將利益上升為權(quán)利的努力,是從規(guī)則的被動(dòng)接受者到主動(dòng)參與制定者的覺醒,是從無序爭(zhēng)利到有序博弈的進(jìn)步。在此過程中,一方的利益得到了維護(hù)和尊重,而又不至于使另一方的利益受到貶損,從而達(dá)到一種博弈均衡的狀態(tài)。博弈均衡有賴于博弈機(jī)制的構(gòu)建和完善,使其成為不同利益主體的制衡與平衡的平臺(tái)和媒介。也使得立法更加貼近生活,符合民意。
[Abstract]:In the transitional period, China is facing more complex and diverse social problems, the core of which is the increasingly superficial interest game. In the past, due to the centralization of central power and the centralization of legislative power in China, which emphasized the consistency and supremacy of national interests, the game mechanism had no suitable soil for its development. In the past 30 years, the diversification of the main body of interest has gradually led to the tendency of the mechanism of fair distribution by the game of interests, which is reflected in the transition from the game of policy to the game of legislation, the essence of which is the legalization of the game of interest. The interest game entering the legislative field is an effort to raise the interest to the right, the awakening from the passive receiver of the rule to the active participant, and the progress from the disorder to the orderly game. In this process, the interests of one party are protected and respected, and the interests of the other party are not derogated, thus achieving a game equilibrium state. Game equilibrium depends on the construction and perfection of game mechanism, which makes it a platform and medium for different stakeholders to balance and balance. Also make legislation more close to life, in line with public opinion.
