建設(shè)法治政府的目標(biāo)和路徑選擇研究

【摘要】：當(dāng)前,我國在不斷深化市場經(jīng)濟(jì)的同時,政府職能也跟著發(fā)生變化。尤其是政府管理經(jīng)濟(jì)方面的職能,可以說是已經(jīng)發(fā)生了本質(zhì)的變化。目前在我國建設(shè)法治政府的過程中,仍然還存在著很多同市場經(jīng)濟(jì)體制及發(fā)展不相適應(yīng)的困難與問題,比如不同程度地存在著越位、缺位及錯位等不良現(xiàn)象,在很大程度上影響制約了我國法治政府建設(shè)的進(jìn)程。因此,我們必須進(jìn)一步健全完善法治政府的職能職責(zé),并把其作為我國市場經(jīng)濟(jì)建設(shè)中的重大戰(zhàn)略問題,切實(shí)抓好抓實(shí)抓出成效。只有科學(xué)合理地處理好政府與市場間的關(guān)系,才能更好地促進(jìn)經(jīng)濟(jì)社會全面快速健康發(fā)展,才能全面推進(jìn)法治政府建設(shè)。我們要清楚地認(rèn)識到只有建設(shè)法治政府,才能不斷健全、完善和發(fā)展我國社會主義市場經(jīng)濟(jì)體制；只有建設(shè)法治政府,才能提供競爭有序的法治環(huán)境和方便快捷的管理服務(wù),從而不斷提升我國政府的競爭力,只有建設(shè)法治政府,才能切實(shí)解決我國經(jīng)濟(jì)、社會、法治與自然協(xié)調(diào)健康發(fā)展。建設(shè)法治政府已成為我國的政治、經(jīng)濟(jì)、文化和社會建設(shè)的核心所在,具有極為重要的政治保障作用,在社會經(jīng)濟(jì)、發(fā)展穩(wěn)定大局中具有極為關(guān)鍵的地位及作用。這必然引起人們對法治政府建設(shè)進(jìn)一步深入研究和探索。 本文結(jié)合我國法治政府建設(shè)的基本現(xiàn)狀,深入闡述了法治政府建設(shè)的有關(guān)理論,并解釋了法治政府的基本涵義、特征以及發(fā)展歷程。分別從立法價值取向存在偏差、政府服務(wù)能力出現(xiàn)欠缺、法治政府建設(shè)不夠透明、行政執(zhí)法非人性化偏離和以人為本精神較為缺乏等方面全面深入分析我國法治政府建設(shè)的現(xiàn)狀,主要分析、對比和研究新加坡法治政府的基本模式、做法與經(jīng)驗(yàn),并同我國的國情結(jié)合起來,進(jìn)一步探討新加坡法治政府建設(shè)及模式對我們的啟示及借鑒,并提出了法治政府建設(shè)的平衡、透明、服務(wù)、人性和道德等具體任務(wù),進(jìn)而從權(quán)力配置合理,健全完善機(jī)制,提升政府能力,行政執(zhí)法人性,塑造公民精神等去探索構(gòu)建我國法治政府的基本框架,從而提出更加符合我國法治政府建設(shè)的具體目標(biāo)與路徑。
[Abstract]:At present, our country unceasingly deepens the market economy, the government function also produces the change along with. In particular, the functions of the government in managing the economy have changed substantially. At present, in the process of building a government ruled by law in our country, there are still many difficulties and problems that are incompatible with the market economy system and development. For example, there are adverse phenomena such as offside, absence and dislocation in varying degrees. To a great extent, it has restricted the process of government construction of rule of law in our country. Therefore, we must further improve the function and responsibility of the government ruled by law, and regard it as a major strategic issue in the construction of our market economy, and effectively grasp the actual results. Only by dealing with the relationship between the government and the market scientifically and reasonably can we better promote the overall rapid and healthy development of the economy and society and advance the construction of the government ruled by law in an all-round way. We must clearly realize that only by building a government ruled by law can we improve, perfect and develop our socialist market economy system. Only by building a government under the rule of law can we provide a competitive and orderly environment for the rule of law and convenient and fast management services, thus continuously enhancing the competitiveness of our government. Only by building a government of the rule of law can we effectively solve our economy and society. The rule of law and nature develop healthily and harmoniously. The construction of a government ruled by law has become the core of our country's political, economic, cultural and social construction, which plays an extremely important role in ensuring political security and plays a crucial role in the overall situation of social economy and development and stability. This will inevitably cause people to further study and explore the construction of government by law. Combined with the basic situation of the construction of the government by law in our country, this paper expounds deeply the relevant theories of the construction of the government by law, and explains the basic meaning, characteristics and development course of the government ruled by law. There are deviations from the value orientation of legislation, the lack of government service capacity, the lack of transparency in the construction of the government ruled by law. In the aspects of dehumanization deviation of administrative law enforcement and lack of people-oriented spirit, this paper comprehensively and deeply analyzes the present situation of our country's legal government construction, mainly analyzes, contrasts and studies the basic mode, practice and experience of Singapore's rule of law government. Combined with the national conditions of our country, this paper further discusses the enlightenment and reference of Singapore's government by law construction and its model, and puts forward the concrete tasks of the construction of the government by law, such as balance, transparency, service, humanity and morality. Then it explores the basic framework of our country's rule of law government from the aspects of rational power allocation, perfect mechanism, promotion of government ability, administrative law enforcement humanity, shaping citizen spirit and so on. Thus, more in line with the construction of China's rule of law government specific objectives and paths.
