【摘要】：由于"法律文化"的概念眾說(shuō)紛紜,考察"法律文化"的實(shí)際"所指"就成為明晰"法律文化"的多個(gè)面向和多重內(nèi)涵的好方法。所謂法律文化之"所指",是指探究學(xué)者是在何種意義上使用"法律文化"一詞,又是采取何種方法對(duì)"法律文化"該層意義進(jìn)行研究。歷史和社會(huì)是法律文化的兩重維度,它們分別指涉從傳統(tǒng)延續(xù)下來(lái)的價(jià)值及特定時(shí)代的社會(huì)結(jié)構(gòu)和權(quán)力結(jié)構(gòu)。受文化人類(lèi)學(xué)的影響,法律文化的研究方法主要有三種典型范式:以"地方性知識(shí)"為基礎(chǔ)的民間規(guī)則和自發(fā)秩序的描述、從象征符號(hào)出發(fā)的意義闡釋以及進(jìn)行"理想類(lèi)型"劃分的文化模式歸納。在中國(guó)語(yǔ)境下,"法律文化"與"法律"存在緊張關(guān)系,這使對(duì)于"法律文化"的研究在一定程度上陷入困境并醞釀著新的方法論超越。
[Abstract]:As the concept of "legal culture" has different opinions, it is a good way to clarify the various aspects and connotations of "legal culture" by examining the actual "reference" of "legal culture". The so-called "reference" of legal culture refers to the meaning in which scholars use the word "legal culture", and what method is taken to study the meaning of "legal culture". History and society are two dimensions of legal culture. They refer to the values inherited from tradition and the social structure and power structure of a particular era. Influenced by cultural anthropology, the research methods of legal culture mainly have three typical paradigms: folk rules based on "local knowledge" and description of spontaneous order. The meaning of symbolic symbol and the cultural model of "ideal type" are summarized. In Chinese context, there is a tense relationship between "legal culture" and "law", which makes the study of "legal culture" fall into a dilemma to a certain extent and a new methodology surmounts.
