【摘要】： 法律英語(yǔ)是英國(guó)、美國(guó)、加拿大、澳大利亞、新西蘭等以英語(yǔ)為官方語(yǔ)言的國(guó)家所使用的法律語(yǔ)言。它是融語(yǔ)言學(xué)和法學(xué)為一體的一種前言科學(xué)。作為調(diào)整人們?nèi)粘Ｐ袨橐?guī)范的工具,法律語(yǔ)言應(yīng)該盡可能做到精確。然而,模糊表達(dá)在法律語(yǔ)言中幾乎隨處可見。 近些年來(lái),這種現(xiàn)象已被許多國(guó)內(nèi)外學(xué)者所關(guān)注并探討。截止目前,有關(guān)學(xué)者對(duì)法律語(yǔ)言模糊性的研究已取得了很大成就,提供了很多寶貴的材料。然而,作為融合語(yǔ)言學(xué)和法學(xué)的一種綜合知識(shí),對(duì)法律英語(yǔ)模糊性這一相對(duì)嶄新的領(lǐng)域的研究依然任重道遠(yuǎn)。 本文在前人研究的基礎(chǔ)上,著重對(duì)法律英語(yǔ)中的模糊表達(dá)用語(yǔ)用學(xué)的理論進(jìn)行分析。法律語(yǔ)言是力求精確的,但立法者在這種力求精確的語(yǔ)言中卻要選擇模糊表達(dá),其意圖和目的是值得深入探究的,而語(yǔ)言順應(yīng)論恰恰為立法者的這種語(yǔ)言選擇提供了合理的理論解釋。根據(jù)維索爾倫的語(yǔ)言順應(yīng)論,立法中使用模糊語(yǔ)言是立法者進(jìn)行語(yǔ)言選擇和實(shí)現(xiàn)語(yǔ)言順應(yīng)的結(jié)果。筆者選擇從結(jié)構(gòu)客體的順應(yīng)和語(yǔ)境關(guān)聯(lián)的順應(yīng)兩方面來(lái)探析立法者在立法中使用模糊語(yǔ)言的動(dòng)機(jī)。在結(jié)構(gòu)客體的順應(yīng)方面,立法者在立法語(yǔ)言結(jié)構(gòu)的各個(gè)層面都會(huì)選擇適當(dāng)?shù)哪：Z(yǔ)言以達(dá)到立法語(yǔ)言結(jié)構(gòu)的順應(yīng)；在語(yǔ)境關(guān)聯(lián)的順應(yīng)方面,立法者在使用語(yǔ)言的過(guò)程中,總會(huì)考慮到社會(huì)語(yǔ)境、心理語(yǔ)境和物理語(yǔ)境的影響,而立法者對(duì)模糊語(yǔ)言選擇恰恰反映了對(duì)這三個(gè)非言語(yǔ)語(yǔ)境的順應(yīng)。在司法英語(yǔ)中模糊語(yǔ)言的使用則是相對(duì)靈活的,其靈活性突出表現(xiàn)為法律言語(yǔ)行為的參與者使用模糊語(yǔ)言來(lái)實(shí)現(xiàn)其特定的交流目的,而這正是合作原則的研究范疇。因此,為了探討法律言語(yǔ)行為的參與者是如何使用模糊語(yǔ)言實(shí)現(xiàn)其交流目的,筆者采用了合作原則和禮貌原則對(duì)法律英語(yǔ)的模糊表達(dá)進(jìn)行分析,闡述如何通過(guò)使用模糊語(yǔ)言來(lái)有意違背合作原則進(jìn)而產(chǎn)生會(huì)話含義的,證明在法律言語(yǔ)交際中使用模糊語(yǔ)言作為一種交際策略可以幫助說(shuō)話人實(shí)現(xiàn)其交際目的,達(dá)到特殊的語(yǔ)用效果即故意隱藏信息、禮貌、勸說(shuō)、自我保護(hù)、填補(bǔ)信息空缺等。 本文通過(guò)對(duì)法律英語(yǔ)模糊性的語(yǔ)用分析,能豐富現(xiàn)有的法律英語(yǔ)模糊性研究的內(nèi)容、拓展該領(lǐng)域研究的范圍,能幫助人們更好的理解、掌握和運(yùn)用法律英語(yǔ),因此有很大的實(shí)踐意義。 本文共分五章。首先為引言部分,提出了本文研究的問(wèn)題及研究方法。第一章為文獻(xiàn)綜述,著重總結(jié)了模糊語(yǔ)言及法律英語(yǔ)模糊表達(dá)的研究現(xiàn)狀。第二章討論了法律英語(yǔ)中模糊表達(dá)的必要性及其實(shí)現(xiàn)方式。由于本文從語(yǔ)用角度分析法律英語(yǔ)中的模糊表達(dá),第三章著重介紹了語(yǔ)言順應(yīng)論以及合作原則和禮貌原則,作為研究的理論基礎(chǔ)。第四章在第三章提供的理論框架內(nèi),分析了模糊表達(dá)在法律英語(yǔ)中的表現(xiàn)。第五章對(duì)法律英語(yǔ)中模糊表達(dá)的功能進(jìn)行了探討。最后一部分對(duì)全文進(jìn)行總結(jié),指出研究的結(jié)果和意義并指出局限和不足。
[Abstract]:Legal English is the legal language used by the United Kingdom, the United States, Canada, Australia, New Zealand and other countries in the official language.
