【摘要】：近幾年來,由于人們不合理的利用古茶園,使其生態(tài)環(huán)境遭到明顯破壞。為使研究更為集中,本文將重點置于少數(shù)民族習(xí)慣法對古茶園的保護(hù)作用研究,在筆者的田野調(diào)查和社會調(diào)查基礎(chǔ)上展開相關(guān)的理論分析,力圖展現(xiàn)少數(shù)民族習(xí)慣法的作用與價值,在肯定習(xí)慣法對保護(hù)古茶園作用的同時對存在的問題進(jìn)行理論分析,提出初步對策。 本文共分為五個部分：第一部分是對文章中涉及到的相關(guān)概念、理論的介紹。本部分主要介紹了少數(shù)民族習(xí)慣法概念及價值,半自治社會領(lǐng)域理論,政策與法律的關(guān)系理論；第二部分是對瀾滄千年萬畝古茶園的概況介紹與論述。對古茶園的地理位置、種群身份、生計狀況以及社會組織進(jìn)行了簡要介紹；第三部分,通過田野調(diào)查,總結(jié)出少數(shù)民族習(xí)慣法對古茶園的保護(hù)作用及價值；第四部分是對少數(shù)民族習(xí)慣法在保護(hù)古茶園方面存在的問題及分析。本部分主要以筆者通過調(diào)查獲取的材料為基礎(chǔ)展開論述,提出了少數(shù)民族習(xí)慣法在保護(hù)古茶園中存在的五大主要問題。最后一部分是少數(shù)民族習(xí)慣法對古茶園的保護(hù)對策及探討。 本文認(rèn)為如何進(jìn)一步發(fā)揮習(xí)慣法的優(yōu)勢,彌補習(xí)慣法的不足以更好的保護(hù)古茶園。
[Abstract]:In recent years, the ecological environment of the ancient tea garden has been obviously destroyed because of the unreasonable use of the ancient tea garden. In order to make the research more concentrated, this paper focuses on the protective effect of ethnic customary law on the ancient tea garden, and carries out the relevant theoretical analysis on the basis of the author's field investigation and social investigation. This paper tries to show the function and value of the customary law of ethnic minorities, while affirming the role of customary law in protecting the ancient tea garden, at the same time, carries on the theoretical analysis to the existing problem, and puts forward the preliminary countermeasure. This paper is divided into five parts: the first part is the introduction of related concepts and theories. This part mainly introduces the concept and value of customary law of ethnic minorities, the theory of semi-autonomous social field, the relation theory of policy and law, and the second part is the introduction and discussion of Lancang's ten thousand mu old tea garden. The geographical location, population identity, livelihood status and social organization of the ancient tea garden are briefly introduced. The third part, through field investigation, summarizes the protective role and value of ethnic customary law to the ancient tea garden. The fourth part is the problem and analysis of minority customary law in protecting ancient tea garden. This part mainly discusses the material obtained by the author through investigation, and puts forward five main problems in the protection of the ancient tea garden by the customary law of ethnic minorities. The last part is the protection of ethnic customary law to the ancient tea garden. This paper argues that how to further exert the advantages of customary law, make up for the customary law is not enough to better protect the ancient tea garden.
