【摘要】：宗教是人類社會長期存在的一種社會現(xiàn)象,宗教與法治的關(guān)系是世界各國和地區(qū)面臨的共同課題之一,也是各國和地區(qū)法學(xué)、政治學(xué)、宗教學(xué)界共同關(guān)注的問題。人類社會有信仰,現(xiàn)代國家離不開法律。國家要處理好法律與宗教的關(guān)系,就必須完善宗教立法、依法管理宗教、發(fā)揮宗教在社會中的積極作用。只有這樣,才能促進(jìn)社會和諧與發(fā)展。本期兩篇文章,圍繞著如何處理宗教與法治的關(guān)系,特別是新形勢下如何正確認(rèn)識和妥善處理宗教與法律的關(guān)系,充分認(rèn)識宗教在維護(hù)社會穩(wěn)定、促進(jìn)社會和諧、推動社會公正等方面的功能和作用,從不同的側(cè)面對主題進(jìn)行了深入分析,或高屋建瓴,或闡幽發(fā)微,或政策建言,均主張將法律的社會治理同宗教的人文關(guān)懷結(jié)合起來,實現(xiàn)古老的宗教在建設(shè)中國特色社會主義與構(gòu)建和諧社會進(jìn)程中的實踐價值。
[Abstract]:Religion is a long-term social phenomenon in human society. The relationship between religion and the rule of law is one of the common issues facing countries and regions in the world, and it is also a common concern of law, political science and religious circles in various countries and regions. Human society has faith, modern country cannot leave law. In order to deal with the relationship between law and religion, the state must perfect religious legislation, manage religion according to law, and give play to the positive role of religion in society. Only in this way, can we promote social harmony and development. The two articles in this issue focus on how to handle the relationship between religion and the rule of law, especially how to correctly understand and properly handle the relationship between religion and law under the new situation, and fully understand that religion is maintaining social stability and promoting social harmony. The functions and functions of promoting social justice and other aspects have been deeply analyzed from different aspects, either from a strategic point of view, or from an elaborate point of view, or policy advice, all of which advocate the integration of the social governance of the law with the humanistic care of religion. To realize the practical value of ancient religion in the process of building socialism with Chinese characteristics and building a harmonious society.
