網(wǎng)絡(luò)實名制立法評析

【摘要】：網(wǎng)絡(luò)實名制既不合國際慣例,也已為世界上唯一的實名制國家——韓國——證明為得不償失。網(wǎng)絡(luò)實名制是直接對公民隱私權(quán)的侵犯,它通過對隱私權(quán)的侵犯間接侵犯公民的安全權(quán),特別重要的是它直接侵犯公民的言論自由權(quán)。從功利的角度來看,它也會妨礙反腐事業(yè),使反腐失去第一推動力。如此不顧國際慣例與前車之鑒的立法之所以出臺,與家長主義立法觀念有關(guān)。
[Abstract]:Internet real-name system is out of line with international conventions, and has proved to be the only real-name country in the world-Korea. Network real name system is a direct violation of citizens' right to privacy. It infringes on citizens' right to security indirectly through infringement of privacy right, especially it directly infringes on citizens' right of freedom of speech. From a utilitarian point of view, it also hinders the cause of corruption, making it lose the first impetus. Such disregard for international practice and the introduction of legislation, and paternalism legislation concept.
