【摘要】：第一次布匿戰(zhàn)爭后,羅馬人占領了西西里,并首次采用行省的形式加以治理,從而區(qū)別于意大利本土的同盟制。此后,隨著羅馬帝國的擴張,行省的數(shù)目逐漸提高到53個之多。因而,行省的治理問題成為羅馬帝國的頭等大事。為此,羅馬人采取了分類而治、設立行省議會、向行省移民、授予行省精英人士羅馬市民權、建立統(tǒng)一的宗教等措施對行省進行治理。由此建立起來的行省制度對羅馬公法和私法都產生了深遠的影響,表現(xiàn)為:混合制憲法的終結、官員薪給制度的確立、新罪名和新型法院的產生、財稅制度的轉型、萬民法的產生、意大利法與行省法二元制的形成,等等。
[Abstract]:After the first Punic War, the Romans captured Sicily and first administered it in the form of a province, distinguished from the Italian confederacy. Since then, with the expansion of the Roman Empire, the number of provinces gradually increased to 53. As a result, the governance of the province became the first priority of the Roman Empire. To this end, the Romans adopted the classification and governance, set up the provincial council, emigrated to the province, granted the province elite Roman city civil rights, established a unified religion and other measures to govern the province. The provincial system has a profound influence on the Roman public and private law, such as the end of the mixed constitution, the establishment of the official payroll system, the emergence of new charges and new courts, and the transformation of the fiscal and taxation system. The emergence of the law of the people, the formation of the dual system of Italian law and provincial law, and so on.
