美國(guó)高等教育司法及其強(qiáng)國(guó)職能

【摘要】:國(guó)家性競(jìng)爭(zhēng)依然是當(dāng)代全球社會(huì)的主要競(jìng)爭(zhēng)領(lǐng)域與形態(tài),這種競(jìng)爭(zhēng)需要強(qiáng)大的國(guó)家做后盾。美國(guó)是奉行“憲法至上”的“法治”化強(qiáng)國(guó),其司法制度嚴(yán)格地源自、依托和維護(hù)憲法權(quán)威,為美國(guó)的強(qiáng)大提供了堅(jiān)實(shí)的法治化支持。美國(guó)司法制度與其高等教育有機(jī)結(jié)合,極大地推動(dòng)了美國(guó)高等教育的法治化發(fā)展,發(fā)揮了重要的強(qiáng)國(guó)職能。在200多年的憲政歷程中,美國(guó)高等教育的司法理念和實(shí)踐在有效發(fā)揮強(qiáng)國(guó)職能方面積累了豐富的經(jīng)驗(yàn),對(duì)尚處于探索、發(fā)展進(jìn)程中的中國(guó)高等教育司法如何更有效地強(qiáng)化和發(fā)揮其強(qiáng)國(guó)職能,無(wú)疑會(huì)有重要的啟示和借鑒價(jià)值,值得我們加以客觀深入的專(zhuān)題探討。 本文由六章構(gòu)成。第一章概括介紹了本文的選題依據(jù)、本課題的研究現(xiàn)狀和本文的研究概況;第二、三、四章分別依次介紹了美國(guó)高等教育司法的基本理念形態(tài)、歷史形態(tài)和現(xiàn)實(shí)形態(tài);第五章扼要分析了美國(guó)高等教育司法的強(qiáng)國(guó)目標(biāo)及職能;最后第六章對(duì)我國(guó)高等教育司法的現(xiàn)狀和特點(diǎn)進(jìn)行了有重點(diǎn)的考察,反思了我國(guó)高等教育司法中存在的問(wèn)題,邏輯地比較、總結(jié)出美國(guó)高等教育司法模式對(duì)我國(guó)高等教育司法的啟示和借鑒。
[Abstract]:National competition is still the main field and form of competition in contemporary global society. The United States is a "rule of law" power that pursues the supremacy of the Constitution. Its judicial system strictly derives from, relies on and maintains the constitutional authority, which provides solid legal support for the United States. The combination of American judicial system and higher education has greatly promoted the development of American higher education by law and played an important role as a powerful nation. In the course of constitutionalism for more than 200 years, the judicial concept and practice of American higher education has accumulated rich experience in effectively exerting the function of powerful nation, and it is still in exploration. There is no doubt that how to strengthen and give play to the function of powerful nation more effectively in the course of the development of Chinese higher education judicature will undoubtedly have important enlightenment and reference value, which is worthy of our objective and in-depth discussion. This paper consists of six chapters. The first chapter introduces the basis of the topic, the status quo of the research and the research situation of this paper. The second, third and fourth chapters respectively introduce the basic concept, historical and realistic form of American higher education justice, the fifth chapter briefly analyzes the goal and function of American higher education judicial power. Finally, the sixth chapter focuses on the current situation and characteristics of China's higher education justice, reflects on the existing problems in our country's higher education justice, and makes a logical comparison. Summarizes the American higher education judicial model to our country higher education judicature enlightenment and the reference.
